Hi All,

I am in the process of completing the i-485 for my K2 follow to join stepchild and have some questions from pages 2, 4, and 15. Our history is pasted below the i-485 questions.

1.       Page 2 question 22a “Was inspected at port of entry and admitted as” – Is answer “K visa” sufficient as the form does not permit entering numerals, or shall I handwrite “K-2 visa” or something else?

2.       Page 2 question 23c “Status on Form I-94” – Is answer “K” sufficient as the form does not permit entering numerals, or shall I handwrite “K-2” or something else?

3.       Page 4 question 5a - Please confirm that K2 is derivative applicant of husband who is primary applicant?

4.       Page 4 question 8 “Receipt number of Underlying Petition (if any)” - Would this be the receipt number beginning with SRC found on the I-797 NOA for the 1-129F?

5.       Page 4 question 9 “Priority Date from the Underlying Petition (if any)” – There is no priority date only a notice date  on the I-797 NOA for the 1-129F. Do we use the notice date or leave blank?

6.       Page 15 Applicant statement questions 1a and 2  – K2 reads and understands English but is only 8 years old. Should I check box 1a or check box 2 and fill out the “preparer” section with my information?

7.       Page 15 Applicant signature – K2 prints in English. At 8 years of age, he does not yet have a signature. Who should sign the form – K2, K2’s father (my husband), or I?

Many thanks for all your help!

Our history:

·       Fiancé entered US 12/20/14 on K1

·       Married 3/16/15

·       Filed for Husband's AOS 3/28/15

·       Husband received conditional green card 10/27/15

·       Husband brought his son (K2) to US on 11/7/15

·       Mailed Husband’s i-751 October 5 (awaiting receipt/response from USCIS)

K visa holder. You can print and write K-2 visa with black pen too.

2.       Page 2 question 23c “Status on Form I-94” – Is answer “K” sufficient as the form does not permit entering numerals, or shall I handwrite “K-2” or something else?

K visa. You can print and write K-2 with black pen too.

3.       Page 4 question 5a - Please confirm that K2 is derivative applicant of husband who is primary applicant?

Yes.

4.       Page 4 question 8 “Receipt number of Underlying Petition (if any)” - Would this be the receipt number beginning with SRC found on the I-797 NOA for the 1-129F?

I-129F NOA1 receipt number.

5.       Page 4 question 9 “Priority Date from the Underlying Petition (if any)” – There is no priority date only a notice date  on the I-797 NOA for the 1-129F. Do we use the notice date or leave blank?

I-129F NOA1 notice date.

6.       Page 15 Applicant statement questions 1a and 2  – K2 reads and understands English but is only 8 years old. Should I check box 1a or check box 2 and fill out the “preparer” section with my information?

Yes.

7.       Page 15 Applicant signature – K2 prints in English. At 8 years of age, he does not yet have a signature. Who should sign the form – K2, K2’s father (my husband), or I?

Not sure. The kid could probably write his name by hand since he doesn't have a signature.

Many thanks for all your help!

Thank you very much KULto ATL. I was also able to find a recent discussion that addresses my last two questions about signatures of minor K2 applicants and whether the parent should list themselves as "preparer" (advice was not to fill out preparer section):

I also searched the USCIS website for information since the link in the 2015 discussion above no longer works and found this information on signatures (see section B3)  https://www.uscis.gov/policymanual/Print/PolicyManual-Volume7-PartA-Chapter3.html
