Mother (Green Card Holder) petitioned son underage 21 now age out for 2 months

I read a few threads regarding age out child that got their visa. But I still want to hear from people that got their experience or really know whats going on.

 

My mother (green card holder) petitioned my younger brother February 2015 when he was 19.

His visa got approved when he was 20. Went for medical BUT St. Lukes found that he have TB (6 months treatment). He went for treatment March 2016 through September 2017. My brother’s birthday was September 19, 1996. We are now just waiting for sputum result and remedical which is (October 23, 2017) + another week for release. If everything is well with his medical he can go to the interview. At this time he have set for Nov 9 interview.

 

My questions are:

1. As my Mother being a greencard holder is my brother protected by CSPA?

2. Does he have a chance to get a visa even aging out due to (Full year compliant) His priority date was March 2016

3. Do we need to file another forms?

Hello! I am in the same case. But for me, i didn't undergo through sputum test. I just aged out after all documents has been filed together with the DS260 and after paying the IV fees. I also received case complete before turning 21. But after i turned 21, i received my interview letter and fortunately I was still included. I'm waiting for my interview next week Oct 24 and I'm still as unsure as you about the whole CSPA thing.

Please please come back here and give us an update.. His interview is November 9. Thats earliest we can get. What is your location in the states? How many months is your age out? His is almost 2 months. I can’t sleep and I am sure my younger brother is the same. He will be coming to Chicago if he can make it.

He went through TB treatment March 2017-September 2017.

I aged out for 2 months already. States location is in seattle, washington. Yes i think we will still be included because we already satisfied the “seek to aquire” permanent resident status through ds 260
