My wife and I were married on Sept. 10 in Delaware and were told that she is not allowed to take my name for her married name.  The marriage state office said that she needs to change her last name in her own country (Philippines) first and then bring back a copy of a new passport with my last name before they will allow her to change her maiden name.  Now we are doing AOS and the form asks for her married name and maiden name.  What do we do?  Should I type in her married name with my last name even though it hasn't been legally changed yet in Delaware?  We would appreciate any advice.  Thanks!

Just use your married name. That official I don't think knows what their talking about. My asawa and I got married in 2012 she did not do the ROM until 2016, but she still took my name on everything after we got married. So just do that.

I agree with @Redheadguy03.

 

In TX, the marriage license is also the marriage certificate, which only takes the maiden name. Regardless, I used my husband's last name for the AOS even my marriage certificate only shows my maiden name. I think that it should be somehow "understood". Only 2 ways to do a name change here suggested by my county: driver's license/state ID (which i can't get yet), and social security. I did a name change for my social security and they sent me a new card with my married name in it.

I'm in pretty much the exact same boat. I'm waiting to get my wife's ssn changed until we get the EAD, but our marriage certificate she had to sign with her new name (that's what we were told to do), but the certified copy still shows a maiden name. We definitely filed with her new name,but we haven't changed her name on the bank account yet or the lease. However, her new name is on our insurance cards. (HR told me to definitely use the new name)
