Hi ! Good day! I have important question to . I have a girlfriend from philippines for more than 2 years. I’m planning to apply K1 visa but i’m still confuse about my income requirements. I just started my job last August 2016 and i filed my tax return last April 2017 and it was only  $10,000 plus but during that time i dont have any over time. And last May 2017 i promited at work and now i had a monthly income of $2000 sometimes more than if i have a lot of over time. I live at my parents but i’m finacially independent. Im 23 and she’s 22 Now, do you think i meet the requirements? How about our age? Does it matter? Thank you for the response!

Refer to the poverty guideline based on your household size: https://www.uscis.gov/i-864p. If it's just you and her, that makes your household size "2" so work out your expected annual income to see if the number meets the poverty guideline.

 

By the time you file and she goes for her visa interview, you'll be referring to the 2018 poverty guideline and there's usually an increase in the number. If you don't meet the minimum for your household size, you can get your parents or some other willing US citizen or LPR to co-sponsor :) The co-sponsor will need to submit a separate I-134.

 

As for your age, so long you're of legal age to marry, that's all good.

But i am living with my parent does i include them to the house hould size? Thanks

If you're not supporting your parents then they won't be part of your household size as they are not your dependents.

Yes i visit her twice already.  Do you think if i payed $900-1300 per 2 weeks i meet the income requirement? Thanks

You have to prove the income is consistent and not going to change. So, I'd recommend not relying on that overtime all the time unless you're positive you can always get it. If you can get a job letter stating how many hours you will have and the wage that would definitely help.

Manila Embassy does not accept co-sponsor any more .... if you google it you will see I am telling the truth and you have to take the poverty guidelines and its 125% of that ,,,

Why, thank you for pointing be that out. I'm posting using a smartphone and didn't click on their profile nor timeline so didn't know that the OP's foreign beneficiary will be going through the Manila embassy.

I have heard it is 100% for initial filing then during AOS filing it is 125%

USEM accepts a joint sponsor for the I-134 only on a case by case basis. With a close family member, they tend to be more likely to permit it.

 

That said, USEM very rarely requests an I-134. You should still have everything ready to go in case they do, though.

In general, yes. COs at some embassies tend to prefer 125%. USEM falls into this category. In reality, there isn't a specific limit as the I-134 is only a tool to help the CO address the public charge concern. The I-864 (for AOS or an I-130 family-based visa) has a clear 125% minimum, but the CO or IO still has the ultimate say on the public charge concern based on the totality of the circumstances.

But theu said that they need the past 3 years Tax Returns what if i did not meet the poverty guidelines in past 3 year but my recent tax meet its? Does it affect my income requirement?

For the I-134, they typically only request the most recent year's tax return...and even then many times they only care about it if you are self-employed or rely on irregular income (i.e. tips, commission, etc.).

For the I-864 - for AOS later - the most recent year's return is required and years 2 & 3 are optional (but all 3 years must still be filed and with incomes listed).

 

A small handful of embassies care about the income from all past years even if current income is sufficient, but USEM tends to look just at the current income.

 

If your base income is sufficient, then I think you'll be fine (if they even ask for the I-134). If overtime pay is needed to meet that income level, then it's a tougher call how the CO would accept that.
