Hello  gentlemen and ladies in the house i greet you all

I ran into an old friend of mine and  he ask me this question  i was dumb for a min before telling him i will get an answer for you as i don;t really know how to advice him.His about 41 yrs old been here for a period of time like 10 yrs.Said he has been assisting the girl with funds to take care of the baby and girl said she can be of help to me also if they can get married.

Below are his questions to me

1. Can he marry a 19 yr old girl and file his papers with her 

2.The 19 yr old has a child from another guy

3.what  are the chances the age difference will not be problem.

 

Sorry i have to write for him since he cannot write English to the best of his ability.please gentlemen and Ladies of the house your wise advice will be of a great advantage to this guy please 

I would appreciate your time on this issue as to help me out personally i don;t know if is the right thing to do or not .

 

Please we seek your advice thanks to you all who has contributed an advice on this topic i forever appreciate you.

no if it isn't his girlfriend and marrying for love, even if that, age and showing bona fide marriage is needed

 

it is considered fraud

 

that is considered using a person to get a GC. tell him he can't do it and stay out of it, you shouldn't be caught in the middle of a fraud

Sorry, that is fraud, it is NOT a trade off of helping financially support a young single mother and child, and her filing AOS for the man. If they aren't in a relationship then it is the man paying the woman to file for him which is that up to 250,000$ fine, and up to 5yr in jail punishment listed on the form details.

**Adjusting from initial Q1/changed to B1 then overstay, termination of removal proceedings**

(STAND ALONE i-130/TERMINATION OF REMOVAL)

First met: Totally random by asking for directions, June 2014 while on vacation at Disney World (L)

Engaged: Aug. 21, 2014

Married: Dec. 1, 2014

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

(AOS AFTER TERMINATION)

Filed AOS packet: March 16, 2016.

NOA1: March 21, 2016.

Biometrics: April 20, 2016.

RFE Initial evidence: April 21, 2016 for birth cert/translation and Q1/B1 i94s

RFE response received: May 10, 2016.

EAD approval: May 25, 2016- Card arrived at attorney's office! Could not pick up until May 30 because we were at Disney World again :):D

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

HAPPY 2YR ANNIVERSARY TO US!!

Infopass #1 at local office: Dec. 19, 2016- Case pending background/security checks, advised when to renew EAD #2

INTERVIEW SCHEDULED!!: interview on March 27, 2017

Text notification, new card being produced: March 29, 2017!!!

He could.  However he would be opening himself up to a world of problems since he is committing immigration fraud which could be found out very easily by USCIS once they reach the interview stage.  And maybe before they even reach that stage.

0% chance considering all of the other red flags that will be prevalent once he files for her.  Along with fraud, as mentioned before.

 

That being said, you shouldn't get involved in any way with your "friend" committing fraud...because it can also come back to haunt you and your own applications down the road.
