Timeline

Hello everyone! My fiance is about to file/send the K1 application. Regarding Criminal Information/Records, my fiance noted all the offenses/charges in the application form but he does not have the court's record on hand. My questions are:

 

1. Does he need to include the court's records in the packet and

2. Do I need the court's records on my interview at the embassy?

 

Your responses will be much appreciated.

Best to enclose the court records or police records (if no court was involved) with the petition. I personally prefer to send in more papers in advance than wondering about a potential RFE. Also, definitely bring a copy for just in case to the visa interview.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

It's good to have copies at the interview. The interviewer will expect you to know all the details of the cases so it's good to show you have read the records and are fully aware of the charges and convictions he has. My husband has a felony and I took everything to the interview and I was asked about it. It's a big red flag if the beneficiary doesn't know the full story.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Timeline

I just went through this at great length leading up to my NOA2 from the CSC.   USCIS wants Certificates of Conviction which are usually a 1-2 page document certified by the Court Clerk.  Save time and future anxiety by making certain there are no COC's that have been forgotten or misunderstood. Go in person to the Court Clerk of each County there is a conviction in and ask the Counter-person  to search the USC's name  to make certain you're not forgetting (mistaking)  any other incidents where a record may have been made. This will show "Unclassified Misdemeanors" (VTL, sealed  & other  convictions that are considered misdemeanor convictions but not usually reported).  A friendly relationship with the Clerk at the counter can save you months of time down the road.

 

Advice  suggesting that ALL court and police documents ever created must be produced, is mistaken. The court's entire  file is not needed either.  Just the COC for each conviction that will be certified by the Clerk on the date purschased.

Does my fiance needs to go the county/state where the hearing was held to get his court records? What if he is leaving in another state is there any way he can get/request for his court records like online perhaps? And if its possible, would it be valid to use  during interview?
