Help on N-400 Part 9

Hi,

I'm in the process of filling out the N-400; I've been a PR since January 2015 by way of marriage (following a K1).

I have a question on this section, as to how it fits with a 3 year PR application.  The questions ask about the past 5 years, not just the time since becoming a PR. 

1. How many days did I spend out of the US - do I include the 2 years prior to my K1 entry (I assume yes but that makes the number very large)?

2. How many trips longer than 24 hours did I take out of the US...well, I can calculate the ones since my K1, but what about the trips to the US that I made prior to K1?  I technically made a trip out the US each time I returned home.

3. List the trips...do I include anything from the period prior to my K1?

I guess if you are 3 year applicant, you just need to count for the last 3 years, since obviously you are living in US for 3 years...

If you are living in US longer than 3 years, for example, 5 years (and married to USC), your application will be considered 5 years case.

Item Number 1. Provide the total number of days (24 hours or longer) you spent outside the United States during the last

5 years.

Item Number 2. Provide the total number of trips (24 hours or longer) you have taken outside the United States during the last 5 years.

Item Number 3. Provide information for every trip (24 hours or longer) you have taken outside the United States during the last 5 years. Start with your most recent trip and work backwards.

Most 3-year applicants only include the previous 3 years for that section.

Yup. USCIS really should update the form (or at least the instructions) to clarify that they only care about three years of history for those applying for naturalization by marriage.

Thanks I will do that.  Should I make an annotation regarding that?

You don't have to---anyone with two brain cells will be able to tell that you are applying under the 3-year eligibility rule based on how you filled out your information at the beginning part of your application....let's hope you get someone with at least two brain cells reading it when you send it in  

 

Some people, after printing the forms, cross out the number 5 and write in 3.

Agreed.

 

I filed my  N400 online---under the 5 year rule.  I wonder if the online version of the application automatically updates the travel questions  to the "previous 3 years" if filing under the 3 year rule when going off of the date of issue of the green card when first filling it out online?

I just filed online today. Sadly, it does not automatically update the travel questions to "previous 3 years".

 

I have done what seems to be the logical thing to do and only included the travel dates for the previous 3 years, since I became a LPR.

Yeah I haven't filed mine as yet but that's what I'm planning on doing too.
