K-1 Waiting time

Good evening or good morning to everyone reading!

 

I am very new to all the marriage process. Me and my man are going to start our application to a K-1 VISA.

 

Do you have any idea of the waiting times before the K-1 visa is approved? 

 

If the foreigner is already in the U.S while sending the petition, does it change anything at all?

It's taking around 7-9 months on average right now. Every case is unique so it could be sooner or much longer. Some embassies take longer than others.

 

Edit: Being in the US at the time of filing is fine (there's a couple questions relevant to that circumstance on the I-129F). If they aren't in the US at the time of filing, those questions can be skipped.

 

Option 2 would be to marry and file for AOS within the US. This is permitted since you are already in the US....you can't leave the US and return again to do this (that would be fraud). Just note that you can't work or travel abroad (and return) for ~4-5 months after filing for AOS+AP+EAD with this path either (just like entering on the K-1).

If you fill out your timeline, it will give you an estimate based on when you file, taking into consideration others who have gone through the same consulate as your fiance's country. You can also connect with others who are going through the K1 in that country to help get a better estimate.
