CR1 help? Direct to consulate or USCIS?

Hi everyone 

 

my husband and I have been let down by our attorney by telling us she is leaving the firm after going through things with us. So we have been weighing up the pros and cons and if it would make any difference if we filed ourselves or with an attorney, do we get better preference with an attorney etc etc. we came to the conclusion it’s going to be quicker and a lot less hassle waiting on our attorney to file the paperwork 

 

I was online earlier and noticed a topic about skipping the USCIS and going straight to the consulate to file as the process can be much quicker. So my question is has anyone ever files direct with the consulate and if so who files? Me being the foreign spouse I’m from the UK and my husband is of course American. I was looking online about applying direct to the consulate and there is one in London. Do I file to them or my husband? I’m confused about this process 

 

any help of course if great thanks

You can only file a petition directly with a consulate if both spouses reside outside the US together. Hence your spouse must be living with you in the UK in order for that to be accomplished.

 

Please visit the USCIS website and do some research.

Ok thank you, that makes more sense now, no he doesn’t live with me in the UK. We will go down the main Channel through the USCIS 

 

do do you think doing it by ourselves is a good option? I am fed up of looking for a lawyer who will actually work quick and not pay them money and have he paperwork sit on their desks!

I can testify that an attorney does not mean the process will be faster.  Our attorney misled us, and it caused at least 3 months delay.  Good Luck

Thank you. That’s awful and this is why we will file ourselves.
