Hi there,

I had a question about the i-751 process. I am filing for myself and my daughter. They received it 9/18/2017. I have paid for my application and my daughter's and I bio metrics fee, was $765.

I got a letter in the mail for my appointment(early October...like 10/3/2017) for my bio metrics to be taken and it was actually today 10/12/17. I have not received a letter for my daughters. Will she have to do one? Isn't it usually mailed together? I am afraid that it got lost if they are usually mailed together or is it after mine is processed.

When we first filed for our original green card she was 17, now she is 20.

I'm assuming, originally you and your child  got your conditional green cards the same day or within 90 thereafter?

 

First of all  -  did you both received Extension Letters? Each of you?.. If not - call USCIS, and try to get on hold a Tier 2 Immigration Officer - you'll need someone with a real access to your case to make sure the kid is not missing and they see she is a dependent on your I-751 (part. 5).  , but people who pick up the phone first do not have this authority.  So, do your best to reach a Tier 2. When if it's done - also ask if her biometric was scheduled.. Usually they are trying to keep applicant and a dependent together... 

 

There have been a lot of 'stories" recently, when a dependent didn't get his/her NOA, biometric appointment.. I'm not an exception - my son's NOA1 has never been sent. The same with biometric letter.

When I got a Tier 2 on hold, we 'learnt" son's  appointment was scheduled for the same day as mine... 

 

I know, it's frustrating, and sometimes I think it would be, probably, better to file a separate I-751 for a kid.. Yes, it would cost more, but at least we wouldn't worry that much... 

 

So, the only thing you can do right now is to clarify what's going on with a dependent on your petition. Call USCIS. Or make an Infopass.

Ah thank you so much, I called at 5:30 today and they told me to call back tomorrow asking for a Tier 2. So you are certainly correct.

 

Yes we filed together on the same day for our conditional green cards.

She did not receive a extension letter, only I did.

I do believe that they lost/she is missing for my file.

Hi... I hope you were able to talk to a Tier 2 today and it did go well.. ???

 

Just from our experience.. and some other VJ folk have been gone through the same things - you, probably, will be (or already have been)  suggested to put a service request, to mail you a duplicate of your daughter's NOA1 (Verification of Inclusion of a Dependent in filing of form I-751).. Just keep in mind that most likely it will never arrive :) and most people ended up, making an InfoPass and going to the local USCIS office to stamp their kids' passports with I-551 stamp. We did his as well :)

 

So, if you decide to do so  - you should  make a copy of daughter's green card, because very often a green card is taken/kept by USCIS in exchange for a stamp.

So I just got off the phone with them.

They told me that my daughter was never scheduled for a bio metrics appointment and she may not even need one. He told me some people don't need to do the bio metrics.. she did do her real estate license recently and they do a bio metrics so maybe that's why... but I could be totally wrong.

 

He did provide me with her receipt number which I am going to sign up for online notifications/link to her email.

 

He also told me that my daughter needs to go into a USISC. She will need to bring her passport and get that stamp just like you said because she is over 18. She should have gotten her own paper like I have. He said that it is required that she has an extension letter also.

We will scan the green card to have it for record just in case they do take the card

 

Thank you so much for your help. Everything you basically said was our case!

She will be going later today to the center as it isn't too far from our house so they we can get this completed ASAP.

Really glad you've been provided with your kid's case #!!!! At least you know now that it has not been missed ans she is "there" :) and also you can track the case.

 

P.S.  Seems like people you got on hold - both times - were really knowledgeable and helpful!!! When I called... well, few times I was told different info by different people.. but finally the last one a Tier 2 an IO was so helpful!! He even faxed me my son's biometric appointment letter and we were able to make it on time. So, really glad it turned well for you today :dancing:

 

So for now... Let "wait game" begin - it's gonna be a while before we hear something back from USCIS :D

Ok so, my daughter went in on nov 2 to talk to an agent. The agent informed her that a new letter will be sent out and wouldn’t get her a time frame on when the letter will arrive. (Agent also said she will get a biometric letter too sometime) The agent did not stamp her passport or take her green card. Even though she told them her card is going to expire... she shrugged and said to wait. It worries me is her card expires on nov 23. She wants to go back to Canada for holiday  (dec 15th) to see her old friends. To this day she hasn’t received anything in the mail nor have I️. The agent told her briefly  about how they mixed up my daughters and my paperwork by merging them together. 

We are unsure of exactly what she meant. 

 

Today, my daughter called in to the hotline to ask for a timeframe for when the letter should arrive. The man told her it takes about 30 days. He told her that since I’m the applicant(The mother), she my daughter, may not even get her own 797 letter/biometrics. She told them other people’s experience and he didn’t care. He told her that he could transfer the call to tier 2 but I️ would have to be on the phone also. I’m currently out of the country and we can’t do a 3 way call. 

 

What should she do?

Should she walk in right when the USCIS tomorrow right at 7 am to request for a stamp on her passport.

 

Should she just wait?

 

Should she reapply on her own application and pay 400~ plus the 85 biometric fee.

We were thinking of photocopying everything and writing a letter explaining the situation just for a response.

 

Should I️ just reapply again? With the letter explaining everything

Well.... I believe the situation you've described above is just another example of  how much stress  an ignorant agent and incompetent Customer Service representative can put on you... 

 

I won't comment that it was not "us' who created Part. 5 in I-751 for a dependent..  I also leave alone a question WHY it is so difficult to issue an Extension Letter for a dependent - a lot of them have to drive, go to school, work, travel and  etc..

What the "agent" said about your daughter may not be getting her own biometric - is completely incorrect as well. As soon as I-751 is received by USCIS, a dependent gets his/her own case#, and it's indicated on Biometric appointment Letter, not on NOA1

 

Anyway, what you should do now is:

1. Make an Infopas appointment to get your girl's passport stamped - they won't do it without an appointment scheduled. 

 

A lot of people, who have a dependent in I-751, are in the same boat - they were told another NOA1 is on its way, but they have never gotten that. And ended up, getting a I-551 stamp in kid's passport.

 

2. You, most likely, have to go with her.... I was with my son  and they looked at my I-797(extension Letter) before they stamped son's passport. Plus she is under 18, so I believe you are required  to be there with her. 

 

BTW, when I called and got on hold a Tier 2, he asked me to have my son connected to our conversation. My son is over 18 and although I am an applicant, he is a dependent, the IO still needed son's "permission" to release the info i requested about his NOA1 and bio.

So, I guess, it works both ways - a kid is UNDER 18 cannot get any info without a principal applicant, and principal applicant cannot get anything as well if a dependent is OVER 18..

 

Why are you saying $400 + bio fee?  I-751 fee is $595.00 plus $85.00 biometric fee...

 

Anyways - your daughter doesn't have to re-apply .  You paid $765.00 (595.00+85.0+85.0) with original submission, right?...  It should be indicated on your Extension Letter as well. If that's correct, your girl is already on your I-751, in part 5, as a dependent. So, no, no re-submission.

 

Also, she shouldn't leave the country without an Extension Letter or I-551 stamp. She, most likely, won't be able to make it back. I am not talking about US Custom - it's about other country. They are unaware of your daughter's status in the US, and she doesn't have any proof of that, so she can be easily denied boarding.

 

Hope you'll make it back to the US before she wants to travel...

In your case I'd just quit calling.  Make an Infopass appointment. Her green card is almost expired, and they cannot ignore it if she doesn't have her NOA1 by that time. 

 

I've already mentioned this before, but ready to repeat - sometimes i think it would be much better, if we had to file a separate I-751 for a child.. Yes, it would cost more, but definitely we would face less stress and wouldn't experience all these "inconveniences"...

 

Hope, you'll get your child's passport stamp before she wants to travel..

How did it end for the you all! I am in the same boat. My daughter was mentioned as a dependent on my I 751 and she got her separate I 797 and a receipt number. I got my biometric appointment but she never got any. After 15 months since applying for ROC my I 751 was approved and there was no trace of her application . I was told by the local office that if they had her file they would have approved it but since they are not in possession of her file - asked me to call USCIS.
