Approved for 130 and 129f but....

My (Thai) wife and I have decided to go the 129f route as it will get her here quicker, probaby by a couple months.

Since we already filled out the 130 and it has been approved and I have paid the 864 fee and the DS has been "generated", can we use all of this for the AOS?

I'm a bit confused on how the AOS works, and I will continue reading on the subject....but the answer to the above would give us a good start-point.

I also wonder what happens in the way of passports. Will my wife get an American passport and be able to travel relatively freely, with me, like an American?? If not...what has to happen to make that happen?

I don't know about the other part you asked about, but I can say that she will not get an American Passport until she becomes an American Citizen. Meaning that if you want her to travel with you out of the country, she will have to apply for a visa as usual.

Yes, she can use the same I-130. There are no fees associated with I-864.

No, she will not have an american passport, american passports are exclusively for american citizens only and she won't be that for a few years, she will have a card known as "green card" and she can travel freely with the passport of the country that she holds citizenship and with her green card. She will still need a visa to go to countries that require visas for citizens of Thailand... except for countries that allow US legal residents to travel without the need of a visa (Canada...Mexico..etc)

I am surprised about the passport. I always assumed that one's spouse, once in America would be entitled to the same travel opportunities as the other. In many countries, it will be near impossible for a Thai woman to get a visa while they will have no problem welcoming her as an American.

We had hoped to travel to Europe next year. Could this be a problem?

The $70 is the fee for biometrics if you applied for her EAD, as there isn't a fee with the I-864.

Sorry about the passport issue, but it is only for American Citizens. As for travel to Europe, as long as she has her green card and her Thai passport AND the country or countries you plan to visit do not require a visa then I can't see there being a problem, but then I'm not a travel agent. A foreign spouse isn't entitled to the same travel opportunities until one becomes an American citizen. As for her getting a Thai visa, maybe it will be easier with her here and married to you...just guessing. You could call a travel agent and ask what requirements she would need to be able to travel freely once she gets her green card. Best of luck!

She won't be traveling (and applying for a visa) as just a Thai citizen, but a Thai citizen with a PR status in the US (The Green Card). That will for many countries make it easier to obtain the visa. Check with the consulate of the country you wish to trvel to for secific requirements.

I got a $70 "processing fee bill" for my 1-864. In fact, I did not know about this and then, with our case being held for 6 weeks at the NVC, I got a letter saying "we cannot process your case until you have paid the $70 fee". I hope that did not mean it just sat there for 6 weeks before I was notified of this.

There's never a dull moment with this stuff, is there? ;)

The $70 dollars fee is for biometrics, like I said there are no fees associated with I-864.

Your wife will still need a visa to Europe, but it will be a lot easier for her to get it, she will request the visa at the embassy here in the US and the fact she is a permanent resident in the US will absolutely help her...

The DoS charges a $70 fee for processing an I-864 for an immigrant visa. The USCIS does not charge a fee for processing an I-864 for adjustment of status.
