Here's our NY state vehicle traffic law. It's a little different than the hand book you studied for the written test. It's 730 pages of laws that I bet all of you break, and not even know it...

Umm..it's a little outta date :)

No earthquakes are rare in the east coast. It was a 4.4 in Delaware. Felt it here. About 200 miles away. 

 

Yes see? There's all kinds of regulations that you've never even heard of, and that book doesn't even contain the local ordinances. 

 

I tell you guys, cops don't like to write summones to people who don't deserve them. And who doesn't deserve a summons? Hard working guy, going home from work, makes an honest mistake, is a pleasant guy. A mom, driving her kids around, again, makes an honest mistake...

Some cops are better than others at using their discretion. They can warn and admonish, or write you one. But you can do a lot to help that discretion.

<sigh> ok...you're very demanding of my brain power in the last couple a days. This #### better stop...

 

If you get stopped by a cop, chances are, you know what you did. So, when he greets you and asks you for your paperwork, don't ask the cop, "what did I do?". Instead, you can say something like, "oh trooper/ officer I'm so sorry, I didn't see you...". 

What's the significance of this statement? 

Picture the cop in his cruiser on the highway, among answering jobs on the radio, he's gotta try to set up to write a summons. It takes him 10-15 minutes to set up nice and comfy, he really doesn't wanna come outta that hole. And you made him do it. 

And why do they write summones? It's proof that he's doing something out there. In a quiet place, a cop is lucky if he makes 1 arrest a month. And his boss see him maybe once or twice a day for 10 minutes. He's gotta have something to show that he's proactive. 

So, you apologized for making him stop you. 

Now if he does ask you, do you know why I stopped you? You can say something like, "is it that I was a little late on that yellow light?" Or "is it that I forgot to put the belt on", "I forgot to signal?" Etc...

Next, he may or may not, give you an "out". A seasoned veteran will ALWAYS gauge you. 

"Mam is there a reason you're in such a hurry?"

"Is there an emergency that youre on your phone?"

Make this count. "I'm sorry officer, my child is sick" etc...

He may go on, "where are you coming from? Where are you going?"

 

"I just got off work, I'm going to get dinner for the kids"...etc...

 

At this point, he may or may not run your license. Some advanced police cars have "plate readers", it already ran you. If he sees that you have a record, or summons in the recent past, etc...that's no good. If he sees a clean slate, he'd probably let you go. 

 

The police officer is trained in social science.  Why should he give an honest working man, or woman, who's having a bad day, a ticket? If it's something stupid, he might very well say, "ok mam, you forgot to signal. Just be more careful in the future." 

 

Then there is what is called an "unavoidable car stop", and, a "felony car stop". That's another story. 

 

But there are also things that you can do to help the cop become friendlier. Turn on the interior light, roll down all your windows, turn off the ignition, put your hands on the steering wheel. 

 

Dont forget, cops are generally conservative family people. And they tend to sympathize with their own. 

 

 

 

 

 

And, put a "blue line" sticker on your back window!

Next. Speed traps...

 

1- lidar, radar...are not accurate around curves. Police are reluctant to clock on a curve. 

 

2- they won't clock uphill. They can't accelerate to chase you. 

 

3- they can't clock from a plane. It's not accurate or practical. 

 

4- they must have a direct sight of you, eyesight and radar = cannot see if there's other cars blocking. 

 

5- if there's more than 1 car in a row all speeding, they can only clock the front car. 

 

6- don't freak and slam on the brakes!

 

7- don't ask for a break if you get stopped. You already got a break, they don't usually stop you unless you're well over the limit. Your break, was between 65-75. And you got stopped doing 80. 

 

8- use other cars to shield your car. 

 

9- highway cops are less likely to cut you a break. 

 

10- the time to be careful is straight level roadways, and crestng over a hill. Clear and dry weather.
