Hi guys, I am currently filling out the required docs for AOS. I just want to clear a few things up, hopefully someone can help. 

 

  • Firstly, my K1 expires on the 24th October - we married on the 28th August. Does this mean I have until the 24th October to file my AOS,? 

 

  • Secondly, I received 2 vaccinations AFTER I received the DS-3025 from the medical practitioner at Knightsbridge, what do I do now? I have a page printed from the doctor to show I had them but I realise that is not enough as it has to be from a practitioner. 

 

  • Thirdly, a requirement is to send the I-693, I need to not worry about this, right? As I handed that in at POE in July, will they automatically have that?

 

Thanks a million in advance if anyone can get around to giving me a little more clarity on these. We have been stressing out so much over getting the money together to file AOS as soon as possible, I slacked on filling in and reading up on the forms required.

1. You can file anytime after you get married for AOS. You do NOT need to file by that date at all, in fact many people file after the 90 day mark to ensure that they have documentation. There are no repercussions for filing it late at all, and you filing it late will be forgiven. Just be advised you will be out of status the time after the 90 day mark until you receive your NOA1. 

2. Sorry I don't know what to say about this.

3.  You handed everything over when you arrived at your POE, so you don't need to fill out anything in regards to that as long as your medical was with in the last 6 months.

Do you have any idea about the I-864, do I have to submit this too? I see theres an I-864A and an I-864. VERY confusing, I wish they would make these things simpler.

Yes, an I-864 from the USC petitioner is required. An I-864A is for a relative that is a household member joining the I-864.

Anything not recorded on the visa medical form must now be put on an I-693 by a US civil surgeon. There are separate instructions to the form that you need to read telling the pages you need to submit. The instructions explain a K1 does not have to complete a full medical exam but you still need the shot page done. The problem you may encounter is a civil surgeon who will insist you need another exam. Or they may say they won't do the immunization page unless the do a complete exam. Call around and ask prices before you pick a civil surgeon.

 

You did not turn in a form I-693 at POE, That form is only used in the US. But yes, your medical exam results were turned in (and they lack needed shots). You still need parts of the I-693 filled out.

Thanks for that! I will look for the separate instructions now. 

 

I booked an appointment with a doctor who deals with visa/immigration and they seemed helpful, they made me an appointment and told me to come in with my documents (the vaccination worksheet) and the one from my doctor in the UK, fingers crossed they will make this simple and just provide me with the needed vaccination worksheet.  The only thing that concerns me about this appointment is she didn't know how much it would be! She told me to bring the cost of the full medical ($200) but I will refuse if they say I need the full medical again, and go back to square one.

 

I called a few different places and spoke to some very rude doctor assistants. One told me I would have to get the injections again and that it didn't matter etc then tried telling me that nowhere would do it for less than $450. Crazy! 

 

On a side note, what are the repercussions of being out of status? For example if we don't get this filed until after the 24th October, will it make things harder when we try do it at a later date?

OP, you shouldn't have any issues with doing the AOS after Oct. 24th. The K1 visa portion has been fulfilled which is that you got married before the 90days was up. While USCIS would like to have you file your AOS/EAD/AP as soon as possible, there is no actual set timeframe for when you have to do this. The only thing you really run into is you are kind of stuck in limbo until you file and get your EAD/AP approved & in the mail. Meaning that you can't work or travel outside of the US and if you haven't already gotten your Social Security Card or Driver's License, then you will have to wait until you have the EAD in most states to get those. As far as the time of being "out of status" that time is forgiven once you get the AOS submitted and processing.

Keep calling places and ask "will you fill out my immunization page only because I have a valid medical on file with USCIS" the ones that know their stuff will say yes and charge you $50 or less.

 

Good news, the new form is out and makes your case for not needing a full medical very clear. It should help you argue your point. It's on the vaccination page. 

  • For applicants who only require a vaccination assessment: Submit only this page with Part 1., Part 2., Part 3., Part 4., and Part 6. of Form I-693.

No repercussions.

Read about what you fill out on the form and take in. 

K1 specific info on page 7 of instructions about not needing another exam.

1. Whenever you want , as long as you married in the first 90 days ! But, remember you couldn't work or go aboard because you get combo card! It takes almost 3months to get it ! 

2. No worries about vaccines, as long as you sent 3025 and all the papers you have! I did the same thing :)
