Hello,

I'm working on filing the Petition for Alien Fiancé(e) for my fiancée with whom I have two young daughters (ages 5 and 6), and they all currently live in Italy. Our daughters already have their reports of birth abroad and SSNs, and we'll probably be going back to Milan for their passports in December.

What I'm having a hard time understanding is how I need to indicate this situation when filing my petition and if the girls need to go through the K-2 process or anything like that (extra vaccinations?), or if they're already set to come to the US once their mother has her K-1 visa.

A secondary doubt is whether our daughters actually need US passports before they come, of if they can travel here with their Italian passports, which they already have. I mean, they've already been to the US for vacation using their Italian passports, but I don't know if that will be sufficient when they come with their mother when she enters the US with her 90-day K-1 visa.

FYI: I'll be filing from northern California.

If they're already US citizens, they should travel on US passports. They don't need (and aren't qualified for) any form of visa.

It is a legal requirement that all US citizens enter the USA on their US passports. Even dual citizens. You must get their US passports sorted asap. As USCs they do not need any visas to enter the USA.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
