K1 visa, pregnancy outside marriage, renunciation of Indian passport after US citizenship

Hi Folks, 

 

Apologies for the long post .

 

Looking for group wisdom. Short version of my (painful) journey: Indian origin guy met Indian girl in early 2016, applied for naturalization in Aug 2016. Still waiting for citizenship which is taking forever. In the meantime,  fiance became pregnant and we kept postponing marriage so I could stick to the (relatively fast)  K1 visa route. Anyway after  a long 15 month wait, my oath ceremony is finally scheduled and I expect to be citizen on Oct 23:D. Child will now definitely be born in India since fiance is 7 months pregnant . Would be claiming child as a US citizen born abroad. Could use help /opinion/confirmation  in these areas:

 

1) Will be flying back to India almost immediately after oath to and spend time with fiance.  Already applied for US passport appointment the day after oath.  Can I also apply for an Indian eVisa right after the oath without going the renunciation process in parallel on Cox and Kings (which sounds painful)? 

2) EVisa seems single entry and I need to shuttle back and forth between India and US for a few times over the next 6 months, so what is quickest way to get a multiple entry visa to India ?  I assume can't go the  OCI route since it might take 2-3 months to process? So I assume have to take the renunciation + Visa route. 

3) Also applying for fiance's K1 on Oct 24 (day after oath) . I am mentioning that Fiance is pregnant on  various narrative sections. Could this be an issue? I assume it strengthens relationship claim and doesn't trigger biases that this petition will result in 2 people coming to America.

4) When fiance is finally called for an interview, could they question why we still chose to go through the K1 route as having a child outside of marriage isn't common in our culture  (I know they legally shouldn't, but my mind wanders  about what more obstacles might come up in this journey :unsure:)

 

Finally someone suggested that with the current political environment , it's wise to have a lawyer involved in the process . Not because they will speed things up, but immigration officers would think twice before acting on their biases.

Hi - As far as I am aware - you wont be able to travel back to India immediately on an Evisa.. reason being that even after u naturalize and become a US citizen u have to officially renounce your Indian citizenship - otherwise you are still an Indian citizen on paper (and as you must have read up, its not legal under the Indian laws to have dual citizenship)

 

Secondly - I am not quite certain if they let you use the evisa being an Indian citizen previously.. better double check with the CKGS guys before you finalize your travel plans.

Thanks! I did see a post on another forum where some folks apparently did apply and we able to travel like this.

Yes, 6+ years as a permanent resident  (and 10 years on a H1B visa before that which I guess doesn't count )

I applied for the tourist visa through Cox&Kings and received my passport with visa delivered back to me within a week. It's a 10 year visa with multiple entries up to 6 months per each visit. I'm not sure how your Indian citizenship status will effect getting the visa so you'd have to contact them regarding that, but as for timing of getting the visa it was surprisingly quick. I'm a US citizen by birth though so not sure how your situation will differ in regards to getting the visa. Wish I had more advice to help on the topic. Congrats for your upcoming oath ceremony and baby on the way!!

Thanks for your feedback and some reassurance about the timings.  The Cox and Kings website is a piece of work:rolleyes: . Anywho, thanks for the good wishes! I managed to take the oath a week early and am a citizen as of Monday! Got my passport today and off to NYC to apply for the visa on Monday.
