Divorce with current k1 sponsor before AOS, found new love - questions!

Be prepared for a lot of scrutiny. If I've seen a few cases in my time on this forum alone, how many do you think USCIS have seen? They know every trick in the book. It's hard to believe that someone could meet and get to the stage of wanting to marry someone in less than 6 months (especially after the pain of infidelity and a broken marriage) but even harder to believe someone changed sexual orientation in that short timeframe too. Normally after a spouse cheats it takes a very long time for the other partner to be able to trust again. Let alone want to marry. 

Wait what? LOL. I missed that the 'new love' is a MAN? Ok then FRAUD pure and simple. One does not become gay in a few days. This OP trying to circumvent the legal process. What country are they from?

Yeah I had to go back and look to. This does not look good at all from any viewpoint at all. 

 

I am not against same sex marriages at all but this just reeks of something nefarious.

So true. I am all for people being happy that's what counts in my book. My feelings have came around to that since my little sister came out to me and let me meet her fiance at that time and now wife. It turns out that Kix(nickname) treats her great and they are happy together and that's all that counts. So that changed my feelings on it because it became personal for me so I had to take a long hard look at myself. But in this situation this just reeks of fraud and trying to circumvent the system.

Ignoring the fact that AOS can only be done with the consent and support of the petitioner, there is 0% chance that USCIS is not going to notice the abrupt change of sexuality.

 

Looks a lot like a marriage of convenience from at least your part ( based purely on your posts) and convincing USCIS it isn't is going to be very, very hard.

People are getting very distracted from the OP original question. I thought the point was to give guidance and not judgment on this forum.

 

I believe she already received some good advice about having to leave the country and reapply for her K1 through her new girlfriend. Immigration will decide whether they feel this scenario is questionable or not.

I am not doing judgement at all but I am evaluating all the circumstances involved just like USCIS will as well. This looks bad on all levels at the very least and I doubt USCIS won't think that as well.

Not your comments in particular but people are getting very distracted and not offering constructive advice.

 

There is a difference between saying the case will likely be under scrutiny because of the scenario or just telling someone they are committing fraud and not offering the constructive route if she were to reapply. That is all.

No no no! If they are in the process of getting divorced and they go to the AOS interview together pretending to be a happy couple, that is BIG time trouble right there. Like misrepresentation kind of trouble. They're getting divorced before AOS is complete. There simply isn't a path to stay unless that relationship is (legitimately) salvaged.

k-1 + San Bernadino k1 Muslim shooter + Trump = every k1 is getting interviewed.  this is why there is slowdown.  trump's increase scrutiny.

 

u will not pass k1 interview without ur husband.  no real marriage = no green card.  that simple.

 

 

Are 100% of K1s being interviewed now? We didn't, and we went through after San Bernardo (but before Trump... barely).

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

People have offered constructive criticism to the OP and she has just brushed it aside. This happens alot on here on VJ is that someone comes on and posts a question like this and does not get the response he/she likes, they get mad and we never hear from them again. 

 

The advice she was given is that she has to go back to the her country of origin and her new fiance has to file a K1 for her. But she did not want to hear it at all.
