This is just a simple question.  I've read numerous times about providing an "Unexpired" I-94 for the AOS process.

 

I've printed out our I-94 on the CBP website.  It has an:   "Admit Until Date: 11/12/2017"

Is this the expiration date of the I-94?

 

So, if I'm looking at this correctly, I need to file our AOS with this I-94, before 11/12/2017? 

What if they don't get to my application till AFTER 11/12/2017?  Will I get an RFE to submit a renewed I-94?

 

We plan on Marrying Oct. 19th.  And given that it takes some time to get the actual certified marriage certificates from the court, I'm estimating that I'll end up filing the AOS on 11/2/17.  Pretty close to the expiration date.

When you file is when it counts...not when they get around to processing it. It will likely take the better part of a year before they get to it. Once you file, you have authorized stay while the case is pending, and the I-485's NOA1 is proof of this authorized stay.

 

As long as you marry within the 90 days, you can AOS based on that even if it's after the 90 days of legal status. Being married to a USC means any overstay is ignored for AOS purposes.

 

And yes, the I-94 from the CBP website  is the right one.
