Hello everybody,

 

Last semptember  we started the K1 application and I received the Noa2, however we then decided to withdraw the application as we broke up ( He got cold feet !! ) . Now we are back together and we want to restart the application, do we need to redo all the application or can i ask to get my NOA 2 again vaild ?

You can ask the embassy if they still have the petition and if it's still valid. They normally renew it for up to a year, but I really don't know if your embassy would do so automatically with no progress on it.

 

If not, you need to start over from scratch. ETA: ~7-9 months now.

I'm assuming you would have to restart the whole process as you withdraw from it, but it's best to call up and double check as I could be wrong. 

31 March 2017 - 1-129f Sent

11 April 2017 - NOA1 Hardcopy 

10 August 2017 - NOA2 Approval Date

19 September 2017 - Medical Appointment

29 September 2017 - Interview 

29 September - 2017 - Visa Approved

When did you withdraw the petition and did you do so in writing and to who? If you have already withdrawn the petition and USCIS has received the request already, then sadly you will have to restart from the very beginning and pay the fee again, etc...Based on your timeline, you just got your NOA2 in september so you are still probably at the NVC stage so the embassy most likely doesn't even have the petition yet so calling them wouldn't really help but you can always see.

Good point...if it was succcssfully withdrawn, then it's dead and the OP needs to refile.

 

I disagree about it still being at NVC, though. I-129Fs are only at NVC for about a week before being sent to the embassy. They would have had the petition many months ago.

Thank you all for your replies, we received the NOA2 in March and he did send a letter to cancel the application. Can we marry and do a spousal visa ? Do i get married in USA or has to be in my country ?

Don't guess. Go straight to the embassy in London.

Use this form https://uk.usembassy.gov/visas/iv-contact/ to ask your question. Don't use terms like NOA2....A fiancé visa petition was approved on my behalf  in March 2017. I want to know if you have the approved petition in London.  May I continue on applying for the visa or does my fiancé need to petition  all over again with USCIS? 

 

That will get you some answers. Be sure and include the name of your US fiancé somewhere in the paragraph, so they have both names for looking things up. Don't expect a same day response because they can be slow. They will eventually answer.

Sorry, yes I misread their date on when they received their noa2 on their timeline, as it looked like they had received the NOA2 on 09/02/2017. I see now it is 02/09/2017.

Thank you all for your help... we at the end contacted a lawyer and my fiancee had to write a letter and get it legalized saying that we are still willing to marry. So now can restart from where we left the application !!

  If they confirmed the cancellation there is no process to un cancel it .  You will have to start over again.  Check threads on here from couples that get into a fight , send in to cancel and then kiss and make up;  They are all told  sorry too late.  

This will not be over quickly. You will not enjoy this.
