Hi guys,

Please help.

I have filed the AOS papers and I got a letter for request for initial evidence.  The thing is, we already have a sponsor, but they say that my husband is supposed to be the main sponsor. 

We came to the states together 8 months ago, we're 20, he's got a job but not good enough to support me. I mean, not on paper. He gets only 3 days a week and he is making more money with tips than on paycheck. And he has been only working in the states for 5 months. Any advice, what do we do??

as the petitioner, he is obligated to file the i864 as the sponsor, regardless of income and attach a letter explaining why he didn't have to file taxes in the past

 

since he doesn't make enough, he can have a joint sponsor, the other person had to file another i864 as his only joint sponsor

It doesn't matter what the main sponsor makes of you have a joint sponsor.

When you say you have the joint sponsor papers sent,  do you mean whey you already submitted? Did you choose the option "joint sponsor" on that form? Otherwise you'll need to fill out a new one.

yes - and indicate joint sponsor on the form. You'll get the chance to amend it when you get the rfe.

Did he earn income while abroad? If so and it was above certain minimum requirements, then he was required to have filed taxes and must do so before he can complete the I-864. If not, then enter "0" and provide a letter explaining why he was not required to file taxes (i.e. he had no income).
