i751 without spousse signature or remarry

hello 

i come to usa with a k1 visa and now i have My CG for 2 years my wife and i having some problemes lately she wanna nove to another state there is no jobs there for me and we have a lot of problmes  lately 
the way i see it we are going separe watys   i have some questions  i really be happy i find  answews 

1- should i send i751  by my self without divorce but without here signatuer ?  or get final divorce and then send i751 before 90 dqy of  green card expire 
2- should i remarry after i divorce and re aply  for a green card   i dont wanna be back to my country again 
im not with here for any  Imigratiomn reason is  here and here ways of treating me always threating me she wont give me papaers if i dont go with here she wanna controle me

It indeed does look like you're only after a GC especially given you're already thinking of remarrying. Where's the wife moving when you know for sure you can't find a job?

If you can provide evidence that your marriage was entered into with bonafide intent (ie. a real marriage from love), you can submit a waiver of the joint filing requirement with your application if you are still legally married at the time of your filing.  They will then RFE you for the divorce decree (you would have somewhere around 87 days to provide them with this.  If you don't, your application would be denied)   Better to submit the I-751 after your divorce is finalized and you have the divorce decree in your hands to submit to USCIS, depending on how quickly you go through your divorce, and staying within the filing time guideline.

You mean find someone else to marry, just to get a green card?  That's fraud, and not a good situation to put yourself in....serious consequences when found out.

Marrying for the purpose to get a green card or other immigration benefits is fraud.
You speak as though you already have someone else to marry and you are still with your wife, why else would the question
even come up about remarrying. Stop jumping from marriage to marriage.
The process is to file for divorce, file the ROC and check mark divorce waiver on the form, then wait for the RFE for the final divorce
decree which would hopefully be done in time and submit it along with evidence of a good faith marriage (ROC guide list).
No signature from your wife needed if you file with divorce.

Yes, you can file without her signature, with a divorce waiver.

It will still be adjudicated on the basis of the evidence of bona-fide-ness that you provide.

However, It cannot be approved until you have the final divorce decree.

 

 

You can send an I-751 with a waiver request at any time between issuance of your 2yr GC and removal from the US......an I-751 only has to be filed within the 90 days preceding the expiry of the 2yr card if it is a joint filing.
