Any information will be welcome. I'm totally lost.... My interview was schedule to April 26 in the consulate, but 3 months ago my husband lost his job and now is receiving benefitc from the Government while looking for a new job desperatly. What can be done ? he used to make more than 5 times more than is required for the poverty guideline... Can he uses his assets ?? Even unemployed will he be able to file the affidavit of support ? Can the 401K be used as "ASSETS" ? Any information will be very helpful.

Get a co-sponsor. He can use his assets but they have to be rather substantial.

I'm sorry for your situation. Unemployment stinks when you don't want it.

1-He is not getting benefits from the gov't the way many of us think of that. Unemployment Insurance in the US is paid into by the employer, and is a time-limited offer.

2-If you are interviewing for the K-3, there is not set limit (but following the I-864 guides is a good idea).

3-I was unemployed when I successfully completed I-864. He can use assets, assets you have, a Joint Sponsor etc. The 401K can be an asset, but tell him he will have to count it first at what he would get if he cashed it in inside of 12 months (there will be a penalty). He then discounts *that* amount to one third its value.

Assets required now are 3X, not 5X, when filing for a spouse. This is assuming the I-864; no guarantees how the CO uses the I-134.

There is no set financial guideline that you need to meet to get a K visa. There are specific thresholds that you must meet for the I-864 or an Immigrant Visa.

The K visa offers more flexibility, but with that comes less certainty that X number is 'sufficient'.

I would go with a Cosponsor and also another advantage since he got laid off 3 months ago, if he made more than is required OVER The proverty line, He can send the 2006 tax return to show he made more than the proverty line, along with his assets. Even if everything goes well Still line up a cosponsor as AOS would be around the corner when you move here.
