And thank you sooooooo much, He's amazing.... I can't stress that enough... 12 years of knowing of someone's existence, always wishing  you could be together,.... now it's finally coming true... He has been there for me in so many ways... I can't wait until he gets off of that plane, and for the first time ever, I will be  able to really hold him, and him hold me. ....

 

He's also 6 foot 7 in, and I'm only 5 foot 2 in. lmao

It honestly depends on what you want to do. If you know you want to get married, then I would apply for the K1 AFTER you two meet in person and have evidence that you met. The K1 visa allows you to go through the AOS process. As far as I know, the B2 visa will not. So if you want to get married, and have your husband become a permanent resident, then go the K1 visa route :) 

 

And I bet! It's certainly and exciting time! :D I can't imagine what it would be like to wait to meet someone for 12 years!

I figured it out lol. I posted too many times. - the website wants me to wait 24 hrs to post again lol - I just made a new user name. 

It's been a long 12 years. we were just kids then, a lot has happened since then. growing up, dating others. 

but with him, I can be myself, I can finally date a real man, he absolutely loves my son..... I can't ask for more than that.

I don't think there is any problem with filing the K1 while he is visiting you.  You really don't need to live together during the process, but I see some general problems that I think you should think about:

 

1.  You shouldn't be thinking about your son "needing a daddy."  That is not the mature thinking of a woman in her mid-20s.  Children are frequently abused by boyfriends and step-fathers and you have no idea what this man is like when he is living with you 24/7.  You need to be wary.

 

2.  You are in your mid-20s with a fairly good salary and a child, why are you rushing into getting engaged without yet meeting in person and acting like being apart is going to be world ending?  This isn't a crush, this is someone you are going to have to spend the rest of your life with and you need to seriously think about whether the compatibility is there.  I had a male best friend (and a little more) at your age - I'm forever glad we didn't marry when he asked me.  See if the in-person chemistry is there and it isn't just a FWB thing.

 

I don't mean to pop your bubble here, but you need to slow your roll.  If you can't stand being apart for the duration of filing a K1 or during immigration proceeding, your relationship is not as strong as you think it is and what you are likely feeling is infatuation.

thanks for your advice, this is all hypothetical, I just want to make sure that I am doing everything correctly. I just want to be prepared, that by the time that he leaves, that if the feeling is mutual, and after 12 years of knowing each other and with the 3 months of physically being with each other, I just want to make sure that this is an option for us. 

 

 

P.S - sorry for coming across needy, as you can imagine after 12 yea of knowing someone, you could imagine the excitement that i feel.

OP, have your partner come in on the VWP. If he applies for a B-2, he may get it denied and then he may not be able to use the VWP at all. 90 days is better than none.

 

To clarify, I mean come in on the VWP for the visit. Then if it all goes well you can apply for the K-1 visa. There's a guide here on this website and you'll find a lot of other people applying for it too. This site was invaluable to me during my CR-1 (spousal) visa.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

That's exactly 90 days according to quick calculation. If so, this is risky...if his plane is delayed, flight cancelled, or he otherwise gets bumped or something, then he will have an overstay. An overstay of even 1 day (starting at midnight, not 24 hours) results in a permanent exclusion from using ESTA in the future. And it makes getting a B2 more difficult (which is already not that easy for a VWP country).

Filing for a K-1 will allow him to come and then file for a green card, but just filing for thee K-1 does not allow him to stay in the US while it is processing. He needs to return home before his 90 days expire.

  1. You can start the K-1 process by filing an I-129F while in the US. The interview & medical is still abroad.
  2. Roughly 7-9 months on average right now, but has been growing all of 2017.
  3. No amount of time. And no formal engagement is required (ring, big scene, etc.) - just agreeing to marry (within 90 days of entry on the K-1) is perfectly fine.
  4. Anytime so long as you have met within the past 2 years (which will be soon for you). It doesn't have to be in AUS, but most times people wait until they are so they can spend their time enjoying the time together instead of doing government paperwork.
  5. Getting a B-2 is not simple, and if denied, would very likely result in him not being able to use his ESTA. Unless there is a compelling reason, sticking with the VWP is highly suggested. You probably don't want to jeopardize being able to visit (in the US).
    1. Edit: One more thing...what ties does he have to return home? His job is not one based on the above.

do not apply for another nonimmigrant visa while the K1 is processing. he can visit you with an ESTA since australia is a visa waiver country. however they may question him more at ports of entry since a K1 is pending. 

you can apply immediately after you are engaged. the only real requirement is having seen each other within the last 2 years.

you're trying to do what most of us wish we could do, which is have our partner with us while doing the K1. I'm sorry to say, it's just not possible. If you have a reason, you can apply to expedite the visa, but they're very picky and most get refused.

Make sure he is home for the process, that's the most honest advise anyone can give you. Be patient, cause this is gonna suck. Come here when it gets too much and you'll find hundreds that can relate to you and cheer you on.
