Ok so my boss pays us super weird. I get 1.50 for every run. 7.25 an hour and all tips. Plus at the end of every night/day he gives us half our hourly. So pay checks for me are around $120 - $200. But i actually make around $2000 a month. For taxes everyone just claims miles for it to equal out cause he doesnt take taxes out himself. I have 0 idea how to file the income part of the k1 visa. Advise is definitely needed. Should i just have a family member sponsor?

Do you mean that you are not reporting and paying taxes for the part of your income that he pays cash? You have to.

Also you have to be the sponsor for your fiancées K1 visa. You can have a co-sponsor for some embassies but not all.

How does he take taxes out (or does he not take them out)? What do you claim on your tax return?

USCIS is not the IRS. However, if you haven't been claiming some income on your taxes, then they won't be counting that income. You can't say "I want this counted now but not at tax time". So if you want it counted, you need to amend your taxes first. And then you need to show evidence of it (i.e. documentation from your employer or possibly bank statements showing regular deposits over a period of time).

You may be able to use a co-sponsor for the I-134. You can use a joint sponsor for the I-864 during AOS (after getting married in the US).

It's not illegal income....it's obtained legally. The issue is with reporting of the income, not how it is obtained.

That plan for reporting taxes doesn't sound right. If you're employees, then he needs to withhold taxes and issue a W-2. If you're independent contractors, then you need to be reporting the full income received as noted on the 1099 he sends (assuming it's over $600/year), not miles traveled. It sounds like he's trying to evade taxes. This can turn ugly...the IRS does catch up to this eventually, and they will get their money. I'll note again that immigration is not the IRS, but it sounds like you're not going to be able to use most of that income (unless you amend taxes to include the full ~$2000/month in income). If your reported and verifiable income is under the minimum to sponsor your fiancee, then you will need a co sponsor. I believe London allows one.

Anakii, do what Geowrian stated above in his post. 

You don't want to owe money to IRS down the road. Might be time to take a trip to H&R block or try their FREE tax preparation on-line.(or a similar company such as taxact.com)

So have YOU filed any tax returns?  That is what you will need to show.  Sounds like this can get ugly real fast so be careful.  I would hate to see the IRS go after you and your employer.  Use your tax returns and get a co-sponsor.  Don't lie but don't offer any additional information that isn't specifically asked for.  Your income may be legal but they way your employer is handling it is not.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

I used to work for a guy like that when I was a teenager. We agreed on X dollars per hour before I was hired. When I started working, he told us he would pay us $3 less per hour cash and he would take care of the taxes.

How foolish I was...

We didn't really have a choice other than quit and I really needed the cash (saving for college). 

Someone might have called IRS, but I can't confirm that to be sure. :o:unsure:

 

I'm sure this happens often, but ultimately it comes down to what is reported to the IRS, as @geowrian mentioned.
