Hello I have two topics I need help with - 


So I am getting my papers ready to send in. I have written on here before about this tax issue I had. Basically the tax preparer screwed up my husband's taxes and filed him as single instead of married filing separate. It got corrected and adjusted to him being married filing separate. I was told just to send in his transcript to avoid any questions or providing extra info that the uscis needed to know. That being said, my husband's transcript still says single on it......I ordered it from the phone number provided. My husband called in and spoke to a representative who said unfortunately we won't be able to get the adjusted transcript, however he was able to mail us a transcript he had on his computer which reflects the adjusted married filing separate status. I don't believe its an official transcript though. So what do I do in this situation? Send in my husbands tax return with him showing single plus his transcript showing single and then the adjusted paperwork from the kind gentleman at the tax office? Then write a letter explaining the whole situation why my husband had his taxes filed separate and why we filed married filing separate in the first place? Another question I have, when I am sending in my tax returns for both years do I need to send in the actual tax returns with the w2s or just the transcripts?

 

The Bank statements......basically me and my husband have our own bank accounts but have a joint credit card plus a joint bank account. We used to used them more frequently than we do now, we use them here and there now. Do I just send the uscis our joint statements in the hope that they wont question the limited activity? Or do I write a letter explaining that we do have our own bank accounts and use those more frequently than the joint ones?

This happened to us. Husband was not on our tax return , we did an adjustment and he took the original tax return plus the copy of the adjusted form , copy of tracking sheet showing delivered at the IRS 

 

During the interview he was not asked for our tax return for 2016 so technically we did all that and stressed about it for nothing.. now this may not happen to you and you may be asked for it. I believe that as long as you show that you corrected the mistake you should be okay. 

(Husband had his IR1 interview in Guatemala on 9/11/17 & was approved)

I think this sort of thing happens a lot.  I've seen other similar issues on this site.  Provide what you have.  These things must come up a lot with people filing taxes after just being married.  Some do it due to a lack of SSN.  I don't think the decision hinges on it.  My impression after getting the approval is the reviewers would rather approve an application than deny one (barring glaring fraud issues).
