I understand your concerns.  Almost all of us here on VJ have had to, at one time or another, obtain legal documents from our home country so we can all empathize with how difficult the process can get---especially in certain countries.

 

At least you can take comfort in the fact that you DO have the option to bring her to the States.  Worse hardship would be those who have families and have no way of bringing them across due to their own legal status.

You might be able to expedite her case through USCIS and/or NVC, but it involves going through the proper channels. There are specific criteria and a process for  that.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It is not "ridiculous"; it is the law.   Her "hardship" is of no concern to the USCIS. You and she are asking for the PRIVILEGE of her immigrating to the US. You both should be grateful and not complain.

 

As a US citizen you should be supporting the laws that apply to everyone and not whine because you cannot break into line. There are so any people on this forum waiting patiently without complaining for far longer than your mother will have to. 

 

The advisors on this forum are the most ethical online. They deserve your respect and thanks for their advice. They are not going to advise you to skirt the rules.

Oh yes, it is so ridiculous!!  I mean everyone should just be allowed to bring their mother/father/spouse/or friend for that matter  into the country without any paperwork.  I think they should just load up planes in India and fill them with people that want to be immigrants and fly'em in here.  Why not?  Or does that sound ridiculous?

Sounds to me like no one planned for your moms future.  Best option for you now:  Move back home to India and take wonderful care of your mother in her sunset years.  That's what a good child would do.

Dude Chill!  I do appreciate the constructive feedback people gave me before yours.  Read.  Expressing an opinion that a law or rule is ridiculous is my right as well..

As opposed to loading the plane in the Phillipines?  I can be snarky all day and night too..

Coming to the US with a visitor visa with the intent to stay and adjust status is immigration fraud. Your mom can and will get a lifetime ban for doing so. This site is monitored by immigration, so what you're intending to do will be caught. The only legal way to bring her here to live is to apply for an IR1. If you want her to move bad enough you'll have to travel there to get her birth certificate and documents in order. You can say it's ridiculous all you want but just think for a moment: why should you be able to circumvent immigration laws and cut the line just because you didn't plan better? How is that fair to those who've done things the proper, legal way and have been waiting for months and months? If you're concerned that she cannot speak English you can request a translator for her interview. My mother in law just had an interview for a b1/b2 and her interview was conducted in Arabic.  Good luck.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
