Hi - I'm applying for a visa for my mother (India).  We will be doing this next year when she's visiting on a B1 visa.  It appears that I can get a birth certificate from the Indian embassy based on her passport.

 

Problem is with her name.  Her passport uses her maiden last name (her father's name).  However on all other documents related to me (my birth certificate, my marriage certificate, etc) the name used was my father's initials.  Eg. Her Name on passport - "First Name/Middle name/Last name".  On my Birth certificate and Marriage certificate "Fathers initials/Mom's first name"    I have sponsored her for a visa three times and submitted letters of support using the passport name and she has visited the US using those documents.  Is that good enough or should I get some other document stating that the two names refer to the same person?  If so, what document?  

 

My father is no more and there was never a marriage certificate.

Are you saying that she plans to file for Adjustment of Status while she is here visiting you on a B1 visa next year?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Just to clarify first---are you a USC or an LPR?

The reason I ask, is that a lot of LPRs think they can sponsor their parents to the US when only USCs can...so just want to make sure first :) 

 

I would think that if you can get a hold of not only her birth certificate in India, but also her marriage certificate showing where she then changed her name legally, it would match up nicely to the name listed on your own birth certificate/marriage certificate to prove parentage.  In her case, I see that there was never a marriage certificate for your parents....was there any sort of marriage contract drawn up by an Imam for them showing the names?

Thanks for the quick responses!..  I'm a US citizen.

 

My mother has neither a birth certificate nor a marriage certificate (the marriage was over 50 years ago) and we don't even have photos (lost in a flood).  Name change is not really formal in India. Back then, you just start using a certain name and that's it, especially if you are a housewife.

 

Since she lives alone in India and nowhere near Mumbai (where she will have to go for AOS) if I applied from there, we thought we could do this while she visits next year.  Wait a few weeks after she arrives on a B1 and then apply.  I know others that have successfully done that and received a GC.  In one case, the parents left the country before their GC was received and the son mailed them the physical GC when it was received.  The parents used that GC on their subsequent visit the following year.

You cannot apply for AOS if your intent was this when crossing the border.  It is immigration fraud.

I know others that have done this and found themselves up a certain creek without a paddle in the end.  

 

She can end up being barred from the States under any circumstance for misrepresentation if found out.

 It is people (you mentioned above) who tried to skirt around the system - planning to AOS after arriving in US with tourist visa, make it harder for other to get tourist visa.

 

Don't be surprised if your mother is rejected for tourist visa.

Because she is coming on a tourist visa and trying to circumvent immigration law by staying and adjusting status after crossing the border with the intent to do so.

 

A tourist visa is just that----to be a tourist.  Not stay and live in the US.

 

It is also extremely easy for USCIS to find out, too.

Tourist visas are for visiting.......any plan to misuse the purpose of that visa can result in severe consequences.  I suggest you read up on petitioning your mother properly.

I was not aware of that.  So the only option would be to file in her home country, even though it would cause extreme hardship for the person?  She's over 80 and did not want to immigrate all these years because she was taking care of my father.  Now I will have to go to India for each and every step. Ridiculous!

OK.  As mentioned earlier, she does not have a birth certificate.  Apparently, the Indian Embassy gives out birth certificates that are acceptable for the GC process in the US.  Can this birth certificate be used in India as well?  Once again, getting a birth certificate or even a non-availability is an onerous process involving bribes, knowing who to bribe, etc and needs somenone (who's not 80) to run around a lot.

Your best bet would be to call them directly and ask.

What is the extreme hardship of applying in her home country?

 

If you are talking about leg-work for her----you can assist her by researching/helping to obtain the documentation needed, filling out any forms yourself on her behalf, paying for financial costs, etc. to make the process easier for her physical-wise.
