First off, this community has been invaluable in the green card application process - so thank you all.

 

My wife and I are in a unique situation right now, and haven't been able to get a clear answer after searching the forums. My wife applied for her green card from student visa, and we have an adjustment of status interview scheduled towards the end of this month. Her passport expired recently, but upon reading the different threads in this forum, we didn't renew it since it shouldn't be an issue during the interview process. However, last week on vacation her wallet was stolen, which contained her state ID and EAD card. We tried getting another state ID, but she can't get one without her EAD card. Applying for a replacement EAD card won't get here in time before the interview for her to get another ID.

 

So a few questions: 

  • I've read on here that generally not having an EAD card (having received one) with you and having an expired passport during the interview is okay independently, but with both - will it pose an issue?
  • We're not sure how to go through security to get to the interview. She can't get a state ID / government issued photo ID, and her passport is expired. I've read that some security doesn't check expiration date on the passport - but don't want to leave anything to chance. Any ideas?
    • She has a national ID card from her home country (China), but it's in Chinese. Not sure if a notarized translation of the card would be acceptable as government issued photo ID
    • She has a soft copy of her state ID, though I doubt security will let someone through based on a picture printed on a piece of paper
    • To get through airport security without state ID, she was able to show 3 forms of verification (bank card with photo, student id with photo, transportation card with photo) to get through security - would something like this work?
    • We filed a police report with the stolen items (EAD card, state ID) which we will bring to the interview, might this help us go through security?

 

We'll get an immigration attorney's input on our situation as well, but wanted to check with y'all too! Thanks in advance.

SInce you don't have enough time I have a suggestion for you. You wife can apply for her new passport(see if you can do it online) from her country's local embassy and let the passport take 1 or month to deliver it wont bother because you will still have a acknowledgment letter from the embassy saying "application for passport renewal is received" as soon as your apply for it so that will act as a proof that you guys at least applied for a new passport !!

 

and for entry into the USCIS office, her current expired passport should be not a problem. If you have photocopies of her EAD then do take it with you.
