Marrying with no social security number (Dallas, TX)

Timeline

My fiance and I are planning on getting married and need to get our marriage license. Will we have any problem with no social security number for them? They entered US with visa and have a foreign passport. We were planning on using the foreign passport as their identification. Any help appreciated and I am so thankful for this site. It truly helps so many families.

What are the requirements for getting a formal marriage license?

 

  • Both parties must appear before the county clerk;
  • Submit proof of identity and age;
  • Provide information applicable to each person for which space is provided
  • Mark the appropriate boxes provided in the application and;
  • Take the oath printed on the application and sign before the county clerk.

 

What can I use as proof of identity?

 

  • Driver's license or identification card issued by this state or another state;
  • United States passport;
  • A current passport issued by a foreign country;
  • An original or certified copy of a birth certificate issued by a Bureau of Vital Statistic for a state or a foreign government (printed within the last 10 years). Must present a valid form of government issued ID; or
  • Military ID card
  • Forms of identification cannot be mutilated(Ex. torn, taped together, or laminated).
does not say anything about a SS Number

It would be strange if SSNs were a requirement. There are so many foreign couples coming to the US on vacation och decide to get married here before going home again, and since they're only tourists they obviously don't have any SSNs. Maybe they just picked the right states to get married in..

One thing to remember OP, is that you don't mention your partner has a K-1 Visa... 

If they entered on a tourist visa, you may very well run into problems with AOS as evidenced from multiple threads and the new decisions on AOS cases within 90 days of entry (unless I read it wrong, they are basically treating ALL cases of AOS requests within 90 days of entry on a non-immigrant (B1/B2/VWP) visa as misrepresentation of your reason for visiting and thus places a *huge* burden of proof on you in order to get AOS.   

 

Hopefully I'm being overcautious and you've got all your ducks in a row, but if you're considering getting married and AOS without the right visa type, the chances are high you may run in to problems.   I hope all goes well :)

No US state requires you to have an SSN before you can obtain a marriage licence or get married.

 

I got married in Texas without one and had no issues doing so.
