hi all,,

I hope this is the right section to post this question. I understand that if I129/I130 are approved then I130 gets hold up here. You need I824 filed to move I130 for further processing (instead of AOS). Now my question is, at what point one can file this? meaning

1). can I file this when I find out that both I129/I130 have been approved? or

2). I have to wait until my wife has K3 interview, she comes to US?

any clarification will do great!!!!

The this is you are showing the you filed both I-130 and I-129f which means you are probably going to follow the K3 route in which case for the K3 you will file the I134 and once she gets here you will file the I-824 with the form I-485

The purpose of filing the I-824 is to tell the USCIS you want consular processing of your I-130 instead of adjusting status in the US after your spouse's arrival. This would mean returning to the home country for the interview. You can file the I-824 anytime after both petitions are approved. The longer you wait the longer it will be until the green card interview.
