Questions concerning IR-1/IR-2 requirements and documents

Hello, I am petitioning for my Filipina Wife and Stepchild daugther (4yrs old). I have few questions concerning the assembliage and the correct documents needed to file IR-1/IR-2 visas.

 

1. Assembling the I-130 Package checklist provided in the guide, is this up to date and in the order of how I am to assemble my document copies to be mailed and filed?

 

2. My Wife's NBI. What NBI document is acceptable, I have read the document must be "green" bearing the title on it: NO CRIMINAL RECORD. if not, what must it read on this document to be accepted by U.S. NVC?

 

3. My Wife registered her firstborn daughter's birth certificate kinda late and no Biological Father or marriage on the document, my Wife has her Baptismal certificate also with no parent of the Father, due to the child being born illegitimate. I am her Stepfather. Our daughter has her mothers maiden name on the birth certificate. Will this affect the evidence of proof in the relationship on me the Petitioner and stepfather to this child or the child's mother? If so, what must we obtain to further prove the child-parent relationship of Stepfather to daughter and/or mother to daughter? Perhaps show proof of shot records or baptismal cert, pictures of the mother with child and Stepfather?

 

4. I have viewed and read the HHS Poverty Guideline for I864 Affidavit of Support. My income from my w-2 shows three years of a gross income of 24,000 - 28,000usd. the guide pdf for 2017 says the petitioner (sponsor)  must meet the requirement of support for three beneficiaries at 25,000 (above the poverty rate of 125%). My question is, Are they saying that the 125% must be higher than 25,000? ( I've attached the 2017 poverty guideline.jpeg.,) meaning 1.25 X (25,525)= 31,906.25, this is the 125% above the poverty line for my gross income or not? Confused. For the last three years, I've made 24,000-28,000 showing on my w-2 (gross income).

 

5. Could someone present to me what an I130 cover letter sample should be written like? and a contents table?

 

6 My wife and I have over four years of Facebook chat logs, does somebody know of a more convenient way to print and show these chat logs as proof of our bonified marriage?

 

7. I (the Petitioner) use XOOM as a way to send income to my Wife in the Philippines, we have transactions spanning back to 2013. Would these transactions if printed be a good evidence of our co-mingling of spousal support? Other than these transactions, we have only ATM receipts. What other proof could we provide of our relationship ?

 

8. Lastly, could someone give me good assembly instructions for mailing this I130 to the USCIS? (organization, fasteners, folders needed etc)

2. The NBI documents are not required until the embassy interview not the initial filing. 

 

3. As long as your asawa has custody of her daughter and there is no name on her birth certificate then the birth is labeled as illegitimate. That means that your wife has sole custody of her daughter, so there is no need for her to show she has custody. You do not need to show that there is any kind of relationship with you as long as your wife has custody of her. 

 

4. Yes, it needs to be 125% of poverty level. 

 

7. Please do not send records showing that you are sending money to her because they don't need that at all and it is not wanted. 

 

8. Please refer to #1

Come on man, I am aware the NBI isn't needed until the interview, u didn't even answer my question, I stated WHAT NBI is needed and WHAT must it say on the document? There are threads saying the doc must be GREEN FORM, also NO CRIMINAL RECORD isn't acceptable for the NVC interview, so what should the document say on it??

 

Please do not send financial records? don't you have to prove you are co-mingling finances?? come on man, explain a little thoroughly on what you meant by that, cause I know they want proof of our finances together.

I will get to the NBI later when I am on my laptop. You sending money to the Philippines is not comingling finances, it is just showing you are sending money to your wife. Comingling is like you showing that you have joint bank or credit card accounts.

 

You are taking the I864 to in-depth and it's confusing you. How many are in your household now? That means you, your asawa, and your step daughter so a household of 3 people. So you take the chart about at the household level of 3 and a 125% of " national poverty level" that means you would have to make at least $25,525 a year gross in order to not need a sponsor.

 

Some of what you are asking for like the NBI clearance is not needed until your daughter and your wife's interview, and not until then . So you do will have at least 10 months to get that together which the USEM wants a NBI clearance dated within the last 6 months from the interview. Has your asawa ever worked as a OFW before?

Last time I read over the guide here on VJ it was not up to date.   I tend not to recommend it because of this.

For the NBI, the GREEN version FOR TRAVEL ABROAD (or USA VISA as they tend to put on there) USCIS does not need this, but NVC and the embassy will want an  original copy.

I added more info, but the "brain for how long one can write the post"  decided it was time and .. well it is there

 

There is a link to the DOS website for a GUIDE to each process from USCIS to USEM (embassy)  Do go to that link

 

3.  No issue with no father being listed on the birth certificate.  Do get copies of the birth certificates from PSA for both wife and step-daughter.

 

4.  For the 125% amount it is $25,525 ... that is the gross income needed

 

5.  Cover letter is a simple table of content.    Please find included the below list of documents ... yada yada.

 

6.  Not needed until the embassy interview, but you only need a sampling, a page or two from each month ... don't get crazy here.

 

7.  If no joint bank account, then XOOM receipts will be the best you can do.

 

8.  I-130/130A  on top, basically stack everything as listed in the I-130 instructions sheet.

 

A bunch of what I wrote got lost because of the limited time frame of VJ (grrrr ! )  If I missed something let me know.

Thank you to all for helping me out with these questions. Since I am filing a petition for two, is ok i also file just one I864 for both petitions or one for each petition? Same also for the I130A? one for each or?

Only the spouse is to complete the I-130A ... but you can complete for her.  

 

I-864 isn't sent with the petition.

 

Once everything is at NVC they will contact you with what they want.

 

At the embassy it is two of everything being there are two visa applications.

Ok. great. thank you all for answering all this in detail. What other evidence I can use to send for the petitions of my stepdaughter, proof of relationship and marital union with my Wife? I have only Xoom transactions, photos of us together and FB chat logs, plane ticket stubs, can I send these as proof attached to both my Wife's I130 and daughter's I130?

 

For the I864. this is great news, so I then qualify if my current year gross income meets the guidelines. When and how do I turn in this financial information, and what do I need to present to them for income? ie: employment letter? I have pay stubs for this 2017 which is the current year I intend to file the petition.

If you don't have a joint account then the zoom transactions will work. All the rest of the stuff you gave documented are good enough as well. So need to worry there. 

 

Good for you that it does seem like you don't need a sponsor. So what you can do is show pay check stubs for a few months and the last couple years of your taxes as well. You will send all this information in the packet that you will send in to file for their CR1 visa.

You list the child on the I-130, Part 4 .. starting on page 6 (25a)  It is that simple.  Birth certificates are NOT needed here.  No 2X2 photo of the child, only of YOU and your WIFE.

 

As I said earlier USCIS doesn't want relationship information, that is for when at the embassy.     Financial/support information is for NVC and USEM ... not USCIS.

 

You only send what is required with the I-130 ... you are mixing things up.

No income documents are needed with the I-130 at USCIS.     Support Evidence (financial documents) will be for NVC and USEM later.

Ok, so let me get this clear. I don't need to send financial statements of co-mingling of finances attached to my Wife's I130 and daughter's I130? And I don't need to file a second I130 for my stepdaughter? just add her on (I130.  Part 4 .. starting on page 6 (25a) ?? 

 

I am confused because the USCIS page states to file a separate I130 form for EACH relative. It goes on to say...

 

"You must file a separate Form I-130 for each eligible relative unless he or she can be considered a derivative beneficiary. See the form instructions for more information."

 

So my stepdaughter is a derivative beneficiary??
