K1 Visa partner has dual nationality

HI everyone, 

 

I'm new to this site, so here goes a nice hello...Hello! 

 

Here is my question.  My partner has a dual nationality. She is from Venezuela and Colombia.  She was born in Venezuela, but has a Colombian dual nationality. I'm currently doing the k1 visa application. Which nationality should I use? Her Venezuelan nationality, or Colombian? 

 

Our evidence for meeting within the last two years is found within my USA passport, and her Colombian Passport in the form of immigration stamps of entry.

I think you will need more evidence of meeting.  Your passport only shows you entered a specific country, not that you both were together.

We have more evidence. We have conversations, pictures together in Colombia, and in Ecuador where we currently live together.  Do you think this should be enough?

We are planning to move back to Colombia January 1st though.

This adds additional questions.  Are you only planning on living in Colombia for a short period, or will this be more long-term?  If longer term, you might want to consider getting married there, then when you do plan on coming back to the US, file for a CR1/IR1 visa at that time.  If short-term, then to your original question, if you go with the K1, then I would have her plan on going through the US Consulate in Colombia.  As to the application, I think you have to show that she holds both nationalities.
