Hi everyone

 

I have some concerns regarding to I864 as below and hope anyone can help me with these:

 

1/ Household size:

Me and my husband completed form together and I am the only principal immigrant he is sponsoring, but household size is 3, instead of 2 (as counted on part 5). Part 3, item 28 we input 1. Then in part 5, as he is married, he needs to input 1 for spouse. Is it making it duplicate?

 

2/ Income and sup doc:

My husband's income for the recent year is quite good and we thought we do not need to give them extra the second and third recent tax return, even do not input info for property (although he owns). Can we? As all these info on form are mentioned "optional".

hi

 

the form states do not list anyone twice, if you are the beneficiary, then he doesn't list you as spouse

 

if he doesn't have any dependents, then the household size should be 2

 

he can send the latest tax year but on the form it is required to list the last 3 years of taxes

 

if he has enough income, then he doesn't need to fill out the part for assets, that is only to supplement income

Item 28 of part 3: enter the total number of immigrants you are sponsoring on this affidavit from item number 1.a.-27: we are required to key in 1 as myself is the only immigrant. However, I am his spouse too, hence we must to key in 1 in item 3. of part 5. It then auto populate household size is 3. Does it mean something wrong here?

 

We can send only the recent tax return report but need to list on form 3 most recent years. Right? As my husband told me that if it is optional to submit the second and the third recent tax return reports, he does not need to submit more than requested.

no, as said, you can't count yourself twice, In this case you don't add yourself as his wife, only as the beneficiary

 

that is in case your husband would be filing for someone else than you

 

for example, a parent, if he was filing for his mom, his mom would be the beneficiary, himself and you as his wife, then the count would be 3 as household size

 

in this case you are the beneficiary and not the wife

 

you do not count yourself twice, you aren't the wife in this petition, so do not put a 1 there

 

as the beneficiary, you are already being counted for the household size

Really appreciate your advice, however, I am really confused right now.

 

You meant that on i864, I am not his wife (as I am the principal immigrant already). It means that we need to declare he is not married, right? If yes, I am really worried that info is not declared correctly.

 

Also, on the other forms (such as i130, i130a, i485...), how we declare your marital status? Single? Or marry 1? 

 

Again for clear explanation, he is my husband and is the petitioner for me (wife, as the only beneficiary) right now. Please advise me and clear my mind out.

you are overthinking, you are his wife and you will fill out the forms as his wife

 

it is just on this section of the i864 to determine household size, if your husband doesn't have any other dependents, then the household size is 2, you already counted yourself as the beneficiary, you don't put a 1 on the wife or the count will give you as 3 people and not 2
