Hello hello, new to this section here. We were thinking about getting a CR-1 instead of a K1, 

So we have a whole new set of questions and stuff that i'd really appreciate getting answers to :D 

We're planning to get married in Malaysia, it will be his 2nd visit here and then applying for CR-1 once he gets back to the US

1. Anyone knows if the 7+21 days marriage waiting time can be waived in Malaysia?

2. Will it be a problem that we're getting married on the second visit? Will that be a red flag for the visa? 

3. Can the joint/co-sponsor be his mother's man? basically the guys not married to his mum yet but they've lived together for 5years+ (he's a retired Sheriff)

Also i still don't understand what is the difference of jointsponsor and co -sponsor (and who fill what form ect)

4. Proof of bonified relationship, joint bank accounts ? How do you go about getting all that done? I heard it's difficult if the person is not present for it. 

5. I'm thinking about going to Indonesia for a temporary stay where my mum is currently living after the wedding and during the (10-14months) wait on the Visa. Will that be a problem? Would it affect my visa in any way and do I need to provide documents of things like this.

6. When is the documents of income needed, first packet or before the interview?

He was in between jobs few years ago he's been getting raises last year and this year and we're expecting a position climb soon

does the USCIS take into account what he's earning previous years or the most current?

Ok, well...

1st question, I don´t have answer 4 that!

2- No it should not be a trouble, but, try in the meantime of the process spent the more facetime that you can, and take photos of you both together etc...

(Just a question, since when you both are a couple?)

3- Yes, that guy can be  joint or co-sponsor, that wouldn´t be a trouble. The form is going to be filled by both,sponsor and co / joint - sponsor, those are forms I-864 and I-864a. 

4-Yes, joint bank accounts is excellent bonafide marriage evidence, substancial one better said! 

5- Well, even in a temporarily change of address at the same country HAVE to be informed by your US Spouse to USCIS, so when papers are filled is kind of hard changing country because in the forms you set what is your current address and  if you change the country, also changes the consulate that is going to be send your papers after NVC stage, so is better if you moved then to that place and then fill the papers once there instead of filling the papers and then move onto Indonesia! Is my better advise about this. Doing in that way is not going to be a trouble!

6- Income documents are needed after NOA2 (try to be proactive at this time) gathering them and having them IN-HAND after NOA2 arrives...

For the interview also you have to have it, so they are needed at two stages (NVC (National Visa Center stage and Embassy Stage).

 

The order of the process is this:

 

1- Filling the I-130 and sending to USCIS.

2- NOA1 arrives (within 2-3 weeks next to sending I-130 ) (long wait starts).

3-Depending the Service Center NOA2 arrives at between 6-10 months after NOA1, or if you have a trouble at I-130, missing document, a mistake at the I-130 form or in the application you receive a RFE (Request for Evidence) (the slowest Service Center is currently Nebraska NSC).

4- After NOA2 your case is transferred to NVC, then you need Affidavit of support, paying another fees etc.. (this stage takes 1-2 months) (after completed you will receive CC (case completed and ready to transfer to Embassy).

5- Embassy stage, at this stage you´ll need original ones of marriage certificate, birth certificate, and again police records...also medical examination, vaccinate records, fingerprints taken etc.(1 1/2 month lenght) After  completed this, with the interview approval the only thing is pay the Immigration Fee.

6-POE (Port of Entry) Entering U.S with the medical SEALED envelope, and all the other papers, Marriage, birth... etc..... then you will receive a stamp at your passport that serves as Green Card for 1 year! After pay Immigration fee the green card should arrives to mail at the US address that you provide in the next 2-3 weeks.

 

Later another process begins ROC (Remove of conditions, that is going to be your case CR-1 VISA) Less than 2 years married!

The entire AVERAGE time of the full process is currently 1 year, I hope that in your case be less than that right!;)

Ah thank you so much, it's all very informative, The part for moving seems complicated i might not do that honestly, but vacations to another country is fine right? We don't need to document or inform that?

+How do we go about getting a joint bank account do we created one here in my country or, because i've heard people having a hard time getting it if the other is in another country?(not present when creating the account)

Vacations no, that´s fine and there is no need to inform that!

The thing of the bank, you should call to the bank, or the banks and ask for that, but should not to be a trouble! Find some info in the banks of your city!

Create you the account and set him as a co-owner of the account, but ask first what you may need for that...Civil documentation etc...

Yes Employer´s letter is need as for the K1 process and also the incomes report etc....

Answers

  1. Someone who knows Malaysian marriage law will need to answer that.

  2. Not likely to be a problem.

  3. Any US Citizen or Green Card holder can act as a Joint Sponsor as long as their income, assets, or a combination thereof meet or exceed the threshold for applicable household size.  When referring to an I-864, Joint Sponsor is always the proper term; not co-sponsor.

  4. USCIS as well as a CO at the Embassy will not expect or require a couple living apart in separate countries to have a joint bank account.  If you can obtain this with little to no hassle, fine; however, you really don't need to go to the trouble or jump through hundreds of hoops to just to get something that's not required in the first place.  By the way, you only submit "evidence" of your relationship, not "proof."

  5. Not a problem.

  6. Those will be submitted to the NVC along with the I-864 between the time USCIS approves the petition and the time an interview is scheduled.  Current income is the only thing that is considered by CO when the I-864 is reviewed.  For the spousal visa process, USCIS plays no role in making a determination.
