NVC Asking beneficiary for form I-864?

Hi everyone,

 

Just received the dreaded email from the NVC stating that our documents have errors or are incomplete.

 

All the forms, before we submitted them were reviewed by an immigration lawyer who stated they were complete! The errors i understand, however it seems like they wanted me, a UK citizen and beneficiary, to fill out form I-864?

 

To my understanding, as the beneficiary, my income in the UK didn't matter. 

 

I have worked on a US summer camp in the past, don't know if that is where the confusion is?

 

Any help/advice would be greatly appreciated.

Letter states the following;

 

INSTRUCTIONS FOR: BIDDLE, THOMAS MARTIN

______F - FINANCIAL EVIDENCE:______________________________________
We reviewed your I-864, I-864EZ, I-864W or I-864A Affidavit of Support form and supporting financial
documents. We found that you didn't provide all the necessary supporting documents or you had
incomplete information or you missed some questions on the Affidavit of Support form(s).
On the attached Affidavit of Support checklist, we have put an "X" by each item you need to correct. Go
to the Department of State's website at http://nvc.state.gov/aos for English or
http://nvc.state.gov/aos/espanol for Spanish and follow the instructions for the Affidavit of Support
form(s). From there, you can fill out a new form, sign, and send the form(s) to the NVC. We require an
Affidavit of Support form for each case regardless of your income level.
Your case is on hold until you send us the items we need. When you return the documents and
completed Affidavit of Support form(s) to the NVC, please make sure that the documents are in the
correct order, as stated in the I-864 Important Notice instructions.

When responding to the National Visa Center, please include the bar code sheet that came with this

The text in my above post is exactly as it is in the letter. 

The mistakes are;

my wife's father forgot to sign one of the forms, Signed in the wrong place

Missing contract between sponsor and household member missing?

you didn't mention if your wife filed the i864 as sponsor

 

if your wife filed for you, she is the sponsor and the sponsor always files the i864. her dad would be the joint sponsor and file a separate i964

 

if she didn't file the i864, then that's the problem

 

you mentioned forms, what forms?

So Dad is joint sponsor and the problem seems to be his part.

  1. He didn't sign his I-864  or signed on the wrong place
  2. If he provided a joint tax return (filed with his wife), the tax return alone is not sufficient to show his separate income qualifies. A joint tax return lumps all income together so NVC does not know what is Dad's and what is his wife's income. His wife (household member) can fill out an I-864A (missing contract) so their joint income as shown on the tax return is pledged to the beneficiary.

It sounds like you are still missing an I-864a from the joint sponsor's wife.

If he provided other proof of his separate income (employer letter, pay stubs), then that should suffice without anything from his wife.
