Hello again.............

I know this is a long way off for us yet, but I like to think ahead :innocent:

When we come to apply for adjustment of status, I am a bit concerned about the financial side of things. We'd prefer to not use a co-sponsor because we would struggle to find one. My fiancee (USC) only works part time and is in college so earns way below the poverty line although she has savings totalling approx. $4k. I have savings totalling approx. $24k and equity in my house totalling approx $150k. We plan to demonstrate all this income/savings/assets when filling in the I-864 for AOS.

My question is in two parts:

1. Do you think this will be enough to satisfy the USCIS that we have enough financial resources to support us? (I'm pretty sure it is but I'd like some reassurance from people who may have been in a similar position).

2. If they decide that isnt enough, what steps would the USCIS take? Would they allow me to re-file with a co-sponsor or would they just throw me out of the country and send me back to England??

Thanks.

Ah! This sounds so familiar to me.........

First let me applaud you for 'looking ahead' down the road to the financial aspect of your journey.

I presume you know you must show evidence of finances at two steps of the K1 process - when you are interviewed at the consulate and when you adjust status stateside.

As an intending immigrant from the UK, you'll most likely find your assets are more than enough for you to 'self sponsor' at the interview stage.

At AOS stage, if you can prove your assets, USCIS will certainly use them to make up any 'shortfall' in earnings of the sponsor. Merged assets of a married couple are also excellent proof of the bonafides of a marriage.

To answer - "will they throw me out of the country" - the answer is no. You would be asked to find another sponsor before they break out the handcuffs! *winks*

I was aware that I have to show evidence of assets to self-sponsor at the interview. From what I've read on here, having around £2k in the bank is supposedly enough so I'm not sweating on that one :D

I was more worried about selling my house in England then getting over to the US, filing for AOS after getting married, then being told that we didnt have enough income/assets/savings and being sent back to England.

The "merged assets" point is a very good one and wasnt something that I had considered.

Thanks for your prompt reply rebbecajo. :D

I would have thought so too. This thread changed my mind... http://britishexpats.com/forum/showthread.php?t=443495

Dunno if there's a new dude working in the Consulate (wrong time of year to change!), but I found this very unusual. First report of its kind.

we are on smae boat,

You are not in the same boat; you are married and this OP is not. Your situations are quite different and the forms and standards to meet are totally different.

You will have better results getting answers to your questions if you make a single post (the Embassy forum is appropriate), reading the pinned posts there, and providing more straight forward information about your case, what has happened and what resources you have to answer the consulate. Please don't tack a reply on ever financial support thread as it will dilute your good answers and confuse you further.

Just to add something slightly on the topic here;

My now husband is a full time student also and works part time and I had a co-sponser and about 5k (pounds) in the bank, but the guy didn't like the amount I had - that was not enough. Even though my money didn't really need to count, the co-sponser made plenty enough. I had to send him in more tax/income info about the sponser (although I just gave him all that) and got the blue slip!

Must of been new and or confused!
