Unemployed fiance visa K1 petitioner

Timeline

I am the petitioner and I don't have a job right now but I want to apply for the fiance visa right now, Or I have to wait until I get a job? I am planning to get one very soon but maybe in 1 or 2 months, And I want to send the forms and everything probably in 1 week is there a problem? They will see this as bad because I do not have a job and I put unemployed in the form where they ask for employment history?

First, have you received your NOA2 or are you thinking about applying for your I-129F?

 

For the I-129F, it shouldn't matter. I'm a student and I've been studying abroad; it was no problem. How much money you make is only a big issue once you go to the interview to actually receive the K1.

 

If they approve your I-129F,  you have to fill out  other forms for the interview. If you don't make enough money (I believe you have to be 125% above the poverty line), you have to get a sponsor who is willing to financially support you and your fiancé. You would then have your sponsor fill out the Affidavit of Support IN ADDITION to your own Affidavit.

I'm just filling the form I-129F but it employment history they ask for your job which I don't have,  so that's my question if there's a problem with not having a job at the time of sending the package with all the documents and the form.

 

But you already answer so THANK YOU.

 

What about if I decide not having a job at all, and I have 2 co sponsors my mom and my moms boyfriends for my fiance interview and my fiance adjustment of status if that's acceptable? He will get his visa, even if I am not making any money? Or I do have to work in order to bring him?

You can apply now but as others have said by the time of interview you may need to present proof of income.

That Wasn't A RESPONSE AT ALL AND  is to bring him MY FIANCE IS A GUY.... I have money  I can pay for that, just answer the question, DO I HAVE TO WORK ? OR JUST WITH MY 2 CO-SPONSORS OR JOINT SPONSORS, AM I JUST RIGHT?

He doesn't want to know the answers, he asked the questions as you said you don't work so wanted you to think about all the fees you have to pay. Some people have no idea about the amount of fees it takes so he was just ensuring you were fully clued up with how much it's going to cost, especially if you don't have a job.

Writing in all capitals comes across as screaming, so yes, you came across as rude. In fact, you just did it again with this reply. A 'thank you for your concern, but those fees are covered' would have looked a lot nicer.

I completely agree with you on this. I've been looking into the K1 for a while now and I still come up with fee's here or there that I haven't thought of before. There's always an extra $50 here of $20 there. It doesn't look like much, but if you add it all up it really adds to the financial stress. It won't be a walk in the park even for us, and we both have full time well paying jobs.

 

 

To answer your original question. No, you do not need a job as long as you have a sponsor that is able to provide for you, your fiancé and every other person in the household. Look up that povertyline thingy. It gets higher as there's more people in the household.

Make sure you and the sponsors realize that they are 100% financially responsible for you! So if you **** up they will pay for it.

While it's none of her business, I thought it was a nice reminder of the main expenses you'll have to pay + living expenses for at least three months after his arrival. 

 

Most families do not have thousands in savings, but good for you for planning ahead and having a plan to support your spouse during his immigration process, the adjustment of status, and the following months until he is authorized to work.

For good reason.  Finances are a big part of why people can be denied.  We all just want to make sure that you realize how expensive this can be.  We all want to help but we have seen people that are overwhelmed when everything starts hitting them at once.  

 

You do not need a job to file the I-129F but your income will be part of their decision process.  We just want to make you aware of that.  

 

We wish you the best.  Make sure that you have seen him in person in the last two years and you have the evidence.  Frontloading is not always a bad idea.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

I think it's important to remember that the questions we all ask here are exactly what USCIS, the embassy, immigration officers at the airport etc. will ask. The point of this website is to try and support each other with the process and give you as much  information to prepare to avoid RFE or worse, denial.

 

If you have everything in order financially then that's great, but it's not insurmountable that the embassy and USCIS will want to know not only how you plan to handle the visa fees, application fees, flights, AOS, but also how you plan to support another person who will be unable to work in this country for a significant period of time. 

 

We are all rooting for you, try to remember that even if people tell you things you don't want to hear :)

to answer the question, yes, you should wait till you have a job

this is not a judgement but embasies look at your income first, then  consider the cosponsor's

it is costly to make the trips to meet, to apply, to pay all the fees that follow

we all know as we did it or are in the process

take all the advice here as meant to help as we try to emotionally support each other and give best possible advice and sernarios of possible effects

your embassy is already a hard one so applying without the means to support (on your own) would probably result in a denial

This also brings up another good point which is post-marriage life style. The OP may have all this already taken care of in some way we don't know about, but if you're unemployed, your fiancee will be unemployed until the adjustment of status, this _MIGHT_ (again, not knowing any details, just going off what I see be a marriage under a lot of financial stress and with the number one cause of divorce being money you might want to consider putting off filing at all till at least you get a job. AND, if nothing else, it'll make your case stronger when you do file since you'll have two co-sponsors and a job yourself.
