Hello i am a DACA recipient and i have a question if someone can shed some light. On page 10, part 8, question 23 of i485 it states "Have you ever applied for any kind of relief or protection from removal, exclusion, or deportation? Would I select yes? Or no? I have never been under any proceedings for removal, exclusion or deportation but isnt DACA a protection from deportation?

You would answer yes. You have applied for DACA, which is relief and protection from removal or deportation.

 

If the question asks for an explanation you would put DACA beneficiary, and enter the petition/case number that resulted in your approved DACA/EAD card

- Removal of Conditions Timeline -

07/31/17 - Mailed I-751 package to California Service Center

08/01/17 - Package delivered to CSC

08/05/17 - NOA1 received by US mail

08/10/18 - Rec'd new NOA1 with 18 month extension instead of 12 months

10/15/18 - Case transferred to Nebraska

12/26/18 - ROC Approved

thank you for responding back.

The package was already sent before you responded. I answered by checking NO. Somewhere in the forum it states that if you unsure or why you answered NO to explain your reason, in which we did.

I stated that "I have never been under any proceedings for removal, exclusion or deportation but I am currently under DACA." I also in that forum attached a copy of my I-797 which contains my petition/case number of the I-821D (DACA)

Why do you think?

I think that should be ok. As long as you explained it, and gave a copy of the I-797  it shouldn't be a big deal. I honestly believe they have other things to worry about and they're not gonna worry about some small technicality which you provided supporting docs for anyway
