IR1/CR1 - I-130 Pending with Nebraska Service Center from NOV 7th 2016

Hi All,

 

I am looking for your expert advise on my current situation. 

 

we filed I-130 Petition for Alien Relative (U.S. citizen filing for a spouse) and pending with NSC (Nebraska Service Center)  from November 7th 2016. There is no RFE or any movement on our application. I called multiple times and spoke to Tier 2 officer, all the time officer told me that our application is in line for review but no update so far. 

 

We have also filed for I-129F and pending with NSC from December 16th 2016.

 

Any advise on how we I can push NSC to review our application and adjudicate.

 

Appreciate your valuable inputs in this regard.

Im confused.  How are you petitioning for a spouse and filing i-129f for fiance at the same time? Did I misunderstand?

and the K-1 was filed AFTER the CR-1???  Something is wrong here....very wrong....

Just to clarify, we filed K3 once we have I-130 receipt number.

Your "mistake" is that you filled for K3 also.

We are in the same boat also. The K3 is what's holding us behind.

I was told once by a Tier 2 that our I-130 was pulled and put together with the I-129F. So I guess we are waiting for the K3 time line now, not the I-130 anymore.

K-3s are almost never approved...at least that's what I have read many places....but good luck..

Look at my timeline

Nebraskas is extremely slow

after a 9 month stay in Nebraska they sent our packet to Missouri for faster processing

nothing had been done in  Nebraska

if i had known this i would have been begging for my application to go to another office / try that

otherwise all u can do is wait it out

it is a heartbreaking long drawn out process 

but i do know there are (according to USCIS site) only 1900 employees and this includes the embassy staff that do interviews 

and there last year November yearly reports show over 400,000 family approved and over 100,000 total visas approved

this does not include the ones still in processing or the ones denied 

so, you can see the work load is extreme

wishing u hear soon as now u are into looking at interview in 2018

Would having Infopass appointment reveal any more details than calling USCIS?

Mainly K3 applicants are the ones still pending from Nov, by trying to get here faster you actually created a much longer wait.

Need to read up on these things, every move made in this process can drastically increase wait time.

Really, they're holding November cases because of the K3s? 

I'm glad I found the forums before applying and I knew that the K3 wasn't worth the money and effort since it was a long shot. 

In my opinion, it is partially USCIS's fault for not updating people on it, at least I couldn't find any information. 

I find it deeply ironic that just like MrHanky said, by trying to get your spouse to the US faster you inadvertently made it slower.

 

it's a phallic move, since the information for the VISA is still available and you can still apply

I mean: 

The K-3 nonimmigrant visa is for the foreign-citizen spouse of a United States (U.S.) citizen. This visa category is intended to shorten the physical separation between the foreign-citizen and U.S. citizen spouses by having the option to obtain a nonimmigrant K-3 visa overseas and enter the United States to await approval of the immigrant visa petition

Not cool, USCIS. The most phallic of moves.

Check my timeline. I applied last november through nebraska as well and my wife has been here since last June. 
Perhaps try to find a way to get yours expedite.

Your case isn't relevant since you're from the Philippines. Its no where near normal processing time.

why not ? I highly doubt they created a department just for Phil processing
