Hello LuciaF,

I am in the same situation as you my i751 is still not approved but i have already applied for N-400 and did my biometrics now i am just waiting for the citizenship interview.

Also i am so sorry but your lawyer is stupid at least she could have gave a reason why you should not apply!!!  the only reason that i can think of right now is you cant apply for citizenship under the 3 years marriage because you and you husband are not living together in the same house otherwise i don't see why you should not apply !!!! a lot of ppl have applied for N400 while their 10 years GC was still not approved with zero complications.

Apply for N-400 Online by your self the process is suuuuuuuuper easy. You do not need a lawyer for N-400.

https://www.uscis.gov/n-400

Good Luck

Thank you for your reply, Elmkiety! My husband and I are living in the same house and everything is great. I will email my lawyer again to give me reasons why I shouldn't apply for the N400. She insisted that we wait for a full 3 year period of time to apply for n400 if I don't get the gc by the 3 year anniversary. I will contact some other lawyers for a second opinion, but I think I will fill out the application online by myself, because 3 months weights a lot in this processes! thank you and good luck to you, too!

😵 I can't believe what I'm reading. Ask your lawyer what's the reason! Simple! I don't see a reason why you shouldn't apply if you are eligible. If there's anything about your case that you might not want to disclose, I would call another lawyer and ask for their opinion. I have heard from one lawyer you should wait for approval too, but if you can easily apply online, I don't see a problem?

I have asked and she keeps saying that there are some professional nuances that she knows and and that is better to wait for my 10 y gc or for the exactly 3 year anniversary (depending which one will be the earlier) to apply for the N400. I have nothing to hide, we are a happily married couple, looking forward to an even happily life together. I was thinking to call another lawyer for a second opinion and I think that I will do so! Thank you for your response AlluringSoul!

Ask her what professional nuances... I would like to know what I'm paying for because I'm pretty sure your lawyer isn't cheap either. But like you said, go ask another lawyer or there are immigration service centers that help fill out applications, they would be able to answer your questions too! 🙂

Here is what a couple of lawyers said in regards to applying for citizenship while the removal of condition process is pending. One said that filing N400 before i751 approval might delay the process a little bit in the long run. I am not sure how accurate that is. Another lawyer said that if my i751 got denied (I applied a few days late with an explanation and might technically be denied) then I will lose the N400 filling fee.

Looks like an October CSC filer got an Update. This was posted in the I-751 September 2017 Filers section though but when I looked at their timeline it said CSC NOA: 2017-10-06. Maybe we can all see some movement soon. My logic is that since we recieved these new 18 month extension letters and a standard RFE usually has a response time of around 90 days (which would put us halfway through the new extension) we should be getting some traction soon. Within the next month or so. But who knows these days!

Hi all,

Has anyone had any issues booking an infopass of late especially in Chicago? I notice that the dates populate but not date can be clicked on and it doesn’t show the next week out like it usually does?
