We also got the 18 month extension letter today..

 

Does everyone's new letters have this wording?  (Note: we do not have an attorney for i751)

"We have mailed an official notice about this case... to the mailing preferences you chose on Form G-28, Notice of Entry of Appearance as Attorney. This is a courtesy copy, not the official notice."

I saw somebody else report that they got a copy but not the original thing. But it's weird cuz they weren't using an attorney either...

So let's see if we find out what this new circus is all about.

Hello all,

 

I'm approaching my 1 year mark from when I sent my ROC(Oct 2017). That means I'm debating if I should apply for N-400(Naturalization) with a pending 751 or not.

According to processing time for us (751@VSC -16months) we are not going to get our 10 year green card anytime soon. As of right now, April 2017 filers are getting theirs and assuming current rate, we won't ours until Feb 2019. The local office is supposedly handling the application but I've seen some conflicting announcements from USCIS transferring applications from one service center to another to better distribute the load. But who really knows how much of that is true!

Based on my understanding, it didn't use to be this way cuz one of the prerex of applying for citizenship was to have your 10 yea gc. Now that 751 is backed up and wait time(for a green card) is overlapping with the eligibility window for N400 application, what are the PRO's and CON's of going in for N400 before an approved 751. This IS a first for USCIS and lately they've been bundling both I-751 & N400 up and transferring them FROM your local office to NBC in Missouri. So let's a dig at it, shall we?

 

CON's

1. Longer wait for 10 year green card: the N400 alone is another 9-13 months wait depending on your local office backlog

2. Application most likely being transferred from local office to NBC for interview scheduling purposes--> hence longer delay

3. When bundled with N400, you HAVE to go for an interview where they will need to pre-approve your I-751 and call you for oath for N400

4. Will need to get Infopass multiple times for travel purposes since this may exceed 18 months extensions, but if you had your 10 year green card you wouldn't need none of that.

 

PRO's

1. While you may have to wait an additional 3-6 months to get your gc in comparison to those who didn't apply for N400 right away, you WILL get your citizenship faster than them. Here's how:
- Right now, the processing time for 751 ~ 16 months. I know this because most April 2017 filers have/are getting 'card being produced' notice and that too without interview. So if they were to apply today for N400, that is 9~13 months away which would put them at Sept 2019. 

- Had they applied in April 2018 instead when their 751 was pending, not only would the count down have started 4 months ago but it would also expedite the N400 because of the pending I-751. With that in mind, they would have had their citizenship in Oct 2018 which is about a year more. So what does that mean for us Oct-2017 filers??

Our timeline looks like this:

One concern i have is Uncle Trump. He's been introducing all kinds of anti immigration legislation lately and god knows what's coming next that could affect our applications. Personally I'm not not willing to take risks waiting, I'm just gonna go for N400 and that too early. (90 days before 3 year green card expiration)

Hi Dave, you are not alone. I am also an October filler and I will apply for a Citizenship in October 2018. Since the I-751 is so backlogged, I am not gonna lose anything if i apply for a citizenship while I am waiting for my green card to be approved.

Me personally... im going to apply for N-400. I hate relying on government for anything and in this case, its processing my paperwork and so i want to get this all over and done with as soon as possible.

 

I look at it like this. (im going to use your numbers)

 

1. Earliest we can expect green card--> Feb2019 (N400 not filed until gc received) + 10 months for N-400 = December 2019 to finally be done with USCIS

2. Earliest we can expect citizenship--> May2019 (N400 filed early onlnine) = May 2019 we are finally done with USCIS

 

I would much rather be done with USCIS for the rest of my life in May 2019 than in December 2019.

 

Would you agree?

 

Even tho I am CSC.. with similar numbers.. the same logic can be applied.

 

I am just ready to be done with all this. I cant wait to never have to think about USCIS again

Mine says the same and I also did not submit a form g-28. This is concerning to me. 

 

Also, note that based on the part you’ve bolded, you have not received your extension letter, but a courtesy copy that we don’t know of it can be used as the official letter.

I may have to be out of the country for work for a 1.5 months and that coincides with the initial 90 day window I can apply for N400. I live in the US and just happen to be traveling during that week. Is it saying that I cannot apply online? I could not find any other documentation elaborating more on this? I wonder if that statement goes along with the first statement about applying based on military service...Thought... anyone?

I heard that you should be physically present in the US when you mail out/e-file your application.  Just to be safe, just prepare everything before you leave and make sure you are back for your biometrics appointment. Yet again, I am not an expert in this field.

I say file for N-400, if you don't mind going through another hurdle like the i-751 interview. I honestly don't think the earliest we can expect something is Feb because I am seeing May & June VSC getting approvals (slow, but still). I checked July filers and I noticed a couple too, so I am hopeful. California filers are a different story because the wait time is 15+, but without a doubt I do encourage to file for N-400 as soon as the window opens.

 

With all that is going on now, you have nothing to lose if the opportunity is there.
