Hi , 

 

Im stuck with affidavit of support for petition my mom . If my income not enough and i want to use my brother in law as joint sponsor ,do i have to file I - 864 ， my brother in law also have to file I-864 and my sister (Dependent of my brother in law) have to file I-864a? 

 

And then my sister and brother in law not citizen or  greencard holder  . My brother in law status is working visa, would that be eligible if i use my brother in law as a joint sponsor ?

Just to clarify, are you a USC or a LPR?   The reason I ask, is if you are an LPR you cannot petition for your parent.

 

If you are a USC, you can use anyone as a joint sponsor, they don't have to be related to the applicant---however, the joint sponsor must be either a USC or alien lawfully admitted to the United States for permanent residence (green card holder).

Thank you for your reply , im a USC. 

 

My sister and her husband neither USC or PR . They only have working visa in USA.  Can i use them as joint sponsor since they are not USC OR PR ?

Who Can Be a Financial Sponsor?

A financial sponsor, including a petitioner, must be at least 18 years old and either a U.S. citizen or a lawful permanent resident (LPR). The sponsor must also have a domicile (residence) in the United States.

The answer is NO. Does not matter if they have social security # or not since they are not USC or LPR.
