HI all - here's my situation. I have a GC. I married after getting the GC in India so in order to be with my wife, I left the US an year ago and did intra company transfer to the UK from US and we're residing the UK at the moment as a family. My wife's 130 is approved and its now time to apply for AOS. I see that as a petitioner I need to provide this affidavit of support and should prove my domicile in the US and also income. When I left the US I left my rented place etc cos i didnt want to keep paying rent for the house where I don't live. I can actually go back to US on the same job with same employer if needed but I personally don't want to do it because I don't know how long it will take for my wife's F2A to get approved. 

 

Having said that, can someone kindly tell me what are my options here?  Is there anyway I can prove my intent to go back to US and settle that can make sure of no issues to my wife's F2A application? I obtained Reentry permit upon my US departure since I know this process takes about 2 years.

So you don't live in the US? How long have you been out of the country? You dun the risk of being considered to have abandoned your residency. A green card is for living in the USA.

I am out for last 18 months but travelled to New York last December. I have reentry permit valid till 2019. I applied for this because I do have strong intent to be back when my wife gets her green card.

But a re-entry permit does not guarantee admission. You may still be questioned about your time overseas. Since you cancelled your lease, took a job overseas and even refer to "living" in the U.K., you have - to all intents and purposes - abandoned your US residency.

What is your priority date? Im abroad with a re entry permit im planning to go back to the us before the interview to be domiciled at that time, for the AOS i have an sponsor, haven't filed yet though im APRIL 14 2016
