Ive been on the fence about getting a lawyer because it's expensive and I've also read that I don't necessarily need one,, I've researched and learned a few things on my own so far.

Hi Dear!

I'm a Nigerian. I have researched on K-1 visa on different sites and read people's testimonies from Lagos US Consulate. I have read three sets of people that were approved that had only one visit (one person met his Fiancé in Ghana and didn't visit Nigeria but was approved). The one visit covers the meeting in person within 2 year interval for USCIS, but endeavour visiting for the interview to have recent pictures and be present during the interview (it has an advantage). Also, remember to have pictures with his family (creates acceptance from the family). We are using a Lawyer because my Fiancé has no time for research due to the nature of his job, and the Lawyer didn't include our chat history and call logs because it might take a longer time (to review all materials submitted) for approval at USCIS stage with front-loaded materials (I'm compiling all that for the interview). You can decide not to use a lawyer if you can have a thorough research and be meticulous in filling out all forms (including necessary requirements). You can take the form piece by piece and can come on Visajourney to ask questions if you encounter any difficulty while filing. Also, the cost for the Legal input is another factor to consider. USCIS stage is a work-over, while the interview is the major stage to prepare for.

 

Although, we have heard USEM Lagos is a tough place to be, I have also read lots of people getting their visa effortlessly. We just need to be prepared, calm and prayerful (God makes the road easy).

1. My attorny put city name in country of bIrth  in i-129f and now in NOA1, country of blrth show as Unkonwn. we called USCIS and they asked us to provide letter to correct it. does it delay in NOA2? or NOA2 would be as per normal timelines.

 

2. My office address has changed recently in same city, so now office address is diff than what is mentioned in i-129f, does it make any issue in future ?

Hi LLNCE!  I know I'm a late to the party but to answer your questions:

 

1: If he's going to visit you and you have the flight itineraries and hotel reservations and anything else as travel documentation already then it would be best to include those in the I-129f packet. If you have other proof (such as documents from previous trips or visits) then it's not necessary but it's nice to build a solid foundation. These must be submitted with the packet you send to USCIS. Sending it afterwards may do more harm than good. I'm not sure if they'll even accept it afterwards to be honest unless they send an RFE requesting such proof. This proof is mostly for convincing them that you guys have met in the last 2 years.

 

2: Chat logs are good but not always needs. I needed chat logs since I don't really call or text my fiance with SMS. I use apps to communicate with him mostly plus my cellphone is prepaid (company phone) so I don't get a monthly bill even when I do call or text him. If you have enough evidence of an on-going relationship with proof of visits, trips together, phone bills, emails, etc then you can still submit the chat logs but they are not necessary.

 

3: I am uncertain of whether or not you can both write on the phone and fill it out on a computer. You have to of course sign it after printing it but I don't see where it says in the USCIS instructions that you can't do both. To be safe those I would stick to only one.

 

4: If you are talking about the G-1145 (Notification of Acceptance of Application/Petition) which you fill out to give them your contact information then yes you must submit this to ensure that you are properly notified of you NOA1 & subsequently your NOA2.

 

5: As long as it is not requested on the form you filled out then no; however, if you or your fiance applied for or was previously denied for a K1,K3 (regardless of if the submission was someone else either you were engaged to) it may come up during an interview or RFE. Other visas are usually kept as separated cases unless (rarely to my knowledge) the visa was denied under circumstances determined by the USCIS.

Chat logs can be sent as proof of a bonafide relationship. In my case, I would need chat logs since I don't use a postpaid phone so I don't have phone bills as proof nor would I have emails as proof because well it's 2017  and why send an email when I can IM? :D

When you wrote the statement of intent to marry, did you write one together and signed it or did you each write one and signed it?

May sound like a silly question, but on the I-129F form, Part 6. Interpreter's contact information, certification and signature, those two pages (10,11) is not to be filled out unless we had someone else fill it out for us, correct? only the last page (p.12).  We are doing it ourselves with no attorney or interpreter.

 

Did you provide a cover letter showing what the package included?? :)

We each wrote an intent to marry statement and signed ours separately. The interpreter section should be filled out if you have an actual interpreter filing for in the case of language barrier, literary difficulty, legal difficulty etc. Yes, a cover letter makes their jobs little bit easier and it's a good way to let them know beforehand what you have submitted and possibly what you have not.

Ummm so 1300 pages of chat logs would be a bit... much lol but I do think if you put about 5-10 pages of snippets of chats spanning across several dates that's fine as it would be proof of an on-going relationship. Just because they're packet is bigger that doesn't mean it's better. From all the things I've read on this forum and others like this, it is really up to your adjudicator. I've seen RFEs for information that was already submitted but seemed to have been lost in transmission or just simply overlooked. You can still bring those chat logs for the interview tho. Just be sure to check the optional checklist form and instructions on the USCIS website and you will be fine https://www.uscis.gov/i-129f

Ahh... well it's really going to be up to your adjudicator. If they don't feel as thought that is sufficient then there will be an RFE but hopefully it won't take long to be processed. Just ensure you get right on that RFE if you get it. Being realistic, it's quite possible since the order shows that he was in Germany but that doesn't seem like enough proof that you were together in Germany and that's required proof of meeting in person in the last 2 years BUT fingers crossed. We will get through this :yes:

Is one meeting enough ? Are the fiancé visas as temperamental as I've read on this site because technically all that is required is one meeting.

 

Ive been on the fence about getting a lawyer because it's expensive and I've also read that I don't necessarily need one,, I've researched and learned a few things on my own so far.

1) Amount of times you have met will not be a problem as long as you can provide adequate proof that the both of you are together in a bonafide relationship.

 

2) No you do not NEED a lawyer. I did it with my fiance and it was fine. If you feel more comfortable having one with you throughout the process then that's fine.

 

3) I think so. I know for the Spouse visa, both spouses can be there for the interview. I have read of cases where the fiance was there for the interview but some of those cases the fiance was requested to be present. It is possibly different from country to country so I would advise that when you get an interview date you have him reach out to his local consulate and inquire if you can be present.

What to do after NOA2:

After USCIS approves the petition, it is sent to the National Visa Center (NVC). The NVC will assign you a case number and send your petition to the U.S. Embassy or Consulate where your fiancé(e) lives.

The NVC will mail/email you a letter when it sends your fiancé(e) case to the U.S. Embassy or Consulate. Once you receive this letter, inform your fiancé(e) to take the below-listed actions to apply for a K-1 visa and prepare for the interview.
