My best guess is that the filing never occurred.  If it did, the attorney is the one to check on it.

If the check is written to USCIS, then the whole package should be returned.  The check is made to Department of Homeland Security, not USCIS.

Yes. Thanks for the clarification.

 

However, the point that I was making was that the check was made out to the appropriate agency and that the attorney did not make a check out to himself.

No one here can tell you what's going on with your specific case. You will have to call USCIS to find out. You definitely should have gotten your NOA one if the check was cashed, so check with your lawyer to be sure he/she does not have it, then call and ask. Sometimes calling at unusual hours can help you get through.

Perhaps the attorney never sent the package. Call the attorney. He/she should have a receipt notice as well. Did the attorney have a tracking number for the mailing?

Hi and good morning, yesterday I called Uscis and they said that only my husband or the attorney could get answers from them.  I then called the attorney and he was not there but his assistant answered and when I asked about the matter he told me to call back in 20 mins.  I called back in 20 mins and he said that he is not seeing anything under our names at all and asked that my husband call the Attorney.  So my husband will call and visit the attorney today.

I called USCIS yesterday but the person I spoke to told me that only the Petitioner or Attorney could call to get answers.  So my husband will call them today.

I called USCIS but they said only the Petitioner or Attorney could get information.  My husband will call today.

Money was given to the Attorney

He said that he was going to call USCIS since last week but he did not get back to my husband with any information.
