Hi everyone, I am new here.  My husband who is a US Citizen filed for me in April 2017.  I live in Trinidad. We have not heard anything as yet.  No receipt notice either.

Your husband will need to call USCIS about this.  It is highly unusual not to receive a receipt notice unless he changed addresses and it was not forwarded.

you are within the time frame for the cr1 visa which is 8 months to a year...You just need to check your receipt number  on the uscis website to get your latest update...but yes, unfortunately is a long process you just need to be patient

I don't have a number because USCIS has not sent it yet.

You should have a Notice of Action (NoA1) within a week, or 2 after sending the package. That's the receipt they received your package and comes along with a receipt number. Where did he send the package? He maybe sent it to the wrong address, but all USCIS cases received a receipt and a number.

The Attorney filed it in April and they cashed the cheque, but my husband has not received a notice of action NOA1 as well as the return of the marriage certificate.

well, I don't think you get that back, I surely didn't received mine back...that's why they always suggest you to get several certified copies...

Well, I think your lawyer is not doing the job right because by this time of the year you should have the NOA1 like since May as a minimum. I strongly suggest you to start a new threat to be respectful to the OP and his post and to ensure other people see it so you can get plenty of help and advice. You are definitely in the right place!!! Besides creating the account try to provide as much information as possible on your timeline too.

 

After you learn how the cr1 process goes, (there are fool proof info here ) you must talk to your husband and you lawyer. Maybe I was too quick to judge and maybe he has the NoA1 in his power which is not rare in cases where lawyers are involved but he should definitely needs to keep you in the loop. 

 

This is a DIY type of website and plenty of us have never needed a lawyer because not only it make too expensive but is also not as hard as you might think. In my case my husband filed for my petition (k1 visa) which is meant for a fiance of an US citizen, and 3 years later I helped him to file a CR1 visa for his biological dad and his step mom (cr1 is used for immediate family like parents and/or spouse of an US citizen) and we never spent a dime in lawyers. Now I'm US citizen and the only help I needed was this site. Im sharing all these because we all have seen cases of incompetents lawyers who makes things way more difficult, so if later on you feel like going through a different route, don't be a afraid on relying on visajourney for support and guidance...and of course this is free!

The attorney said that he does not have the receipt.  He said that USCIS would have sent it to my husband, but my husband has not gotten it.

This is not completely correct. The NOA1 receipt is mailed to your husband and your attorney. We used an attorney as well; they should've submitted a G-28 form, this form authorizes all communication to be sent to your attorney as well your husband. If they haven't received anything as well, something has gone wrong. You should call USCIS and ask to speak to a Tier 2 representative. Find out why the NOA1 hasn't arrived and inquire about the status of your application.

The attorney was supposed to call USCIS to find out what is going on.  I would like to call on my own but I am not sure if they will give me information.

The petitioner as well as the beneficiary can call USCIS at any time. They will ask for basic information about your husband (name, address) and yourself. You should be able to provide this information no problem; they may also ask for your CASE number, but obviously you haven't received it. This is ultimately your visa case, not your lawyer's, and you'll need to stay pro-active.

I would really like to know what is going on because it is already 6 months and no receipt.
