I received an RFE requesting documentation proving  that my fiancé and I met within the 2 year requirement; copy of passport showing travel dates, airline tickets, itinerary, pictures, etc. I provided all of these documents when the petition was filed. So, why would California Visa Processing Center be requesting the documentation with an RFE? Has anyone else experienced this or have any insight. Any information would be appreciated.

It's possible they lost them. That said, what you've provided only shows that you were in the same country together. Photos are secondary evidence (placing a date + location with photos alone is quite difficult). Do you have any receipts from your trip? Ticket stubs for events? Anything else that shows the 2 of you at the same place and includes a date, or can corroborate the date of the photos?

We have a complete itinerary with airline, hotel, excursions with both of our names on the documents and all photos are time date stamped

Just to clarify, are they dated documents from the agents/business/whatever, or your own records? I'm playing devil's advocate here...trying to see if there's a way somebody could have not met within 2 years given the documents you've shown.

 

Photos being date stamped doesn't mean much...you can post-date photos quite easily.

Bottom line Is my immigration attorney sent all the documents with the petition. She said immigration is backed up with files and this is their way of delaying and still be within the time frame.

 I looked at your timeline and noticed you had an RFE...could you share with me what your RFE in regards to?

So you were both on the same flight? Yeah, that's pretty clear evidence then. They probably overlooked it or lost it then. I wouldn't point it at being deliberate, though...it really creates more work (including for the officer issuing the RFE).

Sure. I got an RFE because I met my fiancee via OK Cupid. At the time I filed, they weren't typically requesting proof that OKC is not an International Marriage Broker (IMB). However, they seemed to be taking it more seriously and requiring cases to provide documented proof of this even for the well-known US sites. So I sent a letter from OKC staff saying they are not an IMB + the website's TOS. They approved the RFE 2 days after acknowledging receipt of the RFE response.

Sure. I got an RFE because I met my fiancee via OK Cupid. At the time I filed, they weren't typically requesting proof that OKC is not an International Marriage Broker (IMB). However, they seemed to be taking it more seriously and requiring cases to provide documented proof of this even for the well-known US sites. So I sent a letter from OKC staff saying they are not an IMB + the website's TOS. They approved the RFE 2 days after acknowledging receipt of the RFE response.

When I learned of the RFE I was irritated and thought my lawyer dropped the ball but her paralegal told me they will take care of it and it’s nothing to worry about and they already sent a new copy of the documents today. 

It appears just like with your RFE immigration is questioning everything regardless.

Well there you go. That's the problem. The attorney "sent" the documents. I got an RFE using an attorney.  Now I know that had we filed on our own, we would have not made the mistakes that were made. 🙂  I think I would handle the paperwork from here on if I were in your shoes.

We got the same RFE.. 

The letter that came with the RFE suggested to make an official statement (signed letter) that you met in person. We also did that: rewrote our little story and then my finacé signed it stating he "certifies" we met.

I was going to say the same thing, THAT is the issue here. They had a lawyer do things for them. :P Generally it's much better to do it yourself, because your application isn't that important to the lawyer, but it's very important to you. Don't put something so important in the hands of someone else when you can just as easily do it yourself and keep track of every single little piece of the package yourself.

I highly doubt they would make more paperwork rather then just approve or dis-approve your packet, there must have been something they were skeptical about in what you sent them. This is just my opinion but I think you really wasted your money on hiring a lawyer to do this for you, your still being stressed out and having to put the information together and then relying on someone else to send it off for you, what makes you think your lawyer didn't forget to send something in your packet and now is covering their butt now? See...you can conjure up ideas on both sides of this process.
