Hello Everyone,

 

So my wife had her interview November of 2016, and not a single word. Case study updates on the USCIS website says that her case is still being reviewed. We live in Houston and have been married for 1.5 years now.  Anyone experiencing the same long wait?  Or any advice would be appreciated.  

 

Should we put in a request to visit the uscis site to inquire of the delay?

I would suggest you make an appointment with your USCIS field office and go from there. You can also call the National Service Center at 1-800-375-5283 or submit a Service Request on the USCIS Website. It shouldn't take 10 months to get an approval or denial notice. Most of the filers I've seen got an approval message the same week, some people even the same day.

Thanks for the reply Ty. 

 

We have done that before. We did a few months after our official wedding to submit more evidence of our wedding photos. But still no new notifications. We have also called in multiple times to inquire about our case and even had them put our request “flagged” (I forgot the terminology).

Does she have her EAD and AP? How close are you to your second anniversary? The reason I ask both questions is because if she's not approved for her green card before your second anniversary, she'll receive a card with an expiration date of 10 years. Prior to your second anniversary, you'll have to spend another $500+ to remove conditions in two years. So if it's not affecting her ability to work, travel, and sleep (aka causing lots of stress) you might want to sit tight a few more months before starting to escalate your case again. I know when my husband's was processing every day seemed to drag so we would have had a hard time waiting. But it is something to consider. Since you didn't get results from your first service request, feel free to notify your congressman and ask them to get involved. I'd also schedule another infopass to speak to someone in person.

Hi JR,

 

She is an F1 student and does have her EAD for the past two years now. We just submitted again for her EAD renewal. She is allow to renew as long since she is student (studying for her nursing).  So you are suggesting to wait til our 2 years anniversary and we will automatically get a 10 year green card?  If so, do we have to file to notify them of our second anniversary?  Thanks for replying. I have not heard of this.

In another thread you write this "We filed in October 2015, interview in November 2016, and still no word." That means you must've married in October 2015 at the latest, so you have been married for 2 years now. That means you will automatically receive a 10 year greencard instead of the 2 year one, you can then skip the ROC.

I'm sorry if I gave you the impression that approval after 2 years was automatic. It's not. But hopefully your wife will be approved. And if it's after your 2nd wedding anniversary then she automatically gets the 10 year green card. No matter when you decide to investigate what's going on, the USCIS will have to make their decision.

Hi Gro. You are correct. We were officially married April of 2015. We had a family emergency so was not my able to submit paperworks until October.  So from the sound of it, if we get approve, we will get the 10 years and not the 2 years.

I am sorry to hear that your case is still

stuck, one of the reasons could be that her background check is still pending, the Field office might have interview but cannot approve till the point background check has a green light.

 

unfortunately even congressman cannot expedite the same, such delays happen in less than one percent of the cases, however to confirm that it is still stuck in background check, u should approach the congressman’s office and they could get USCIS to give an official reply for the same. 

 

 

ROC Timeline

 

June 15, 2020: Sent package through USPS

June 18, 2020: Delivered to Arizona PO box

June 23, 2020: Credit Card Debited

June 24, 2020: E notification for case (LIN-Receipt) 

July  15, 2020: Case was updated to show that fingerprints were taken

July 16, 2020 : Official NOA letter dated July 1 was received  

July 20, 2020 : Official fingerprint taken notice dated July 15 was received

March 05, 2021: Status updated to "Card in Production"

March 06, 2021: Status updated to I-751 Approved
