My Husband stole my green card and passport - HELP

I have a friend she is married to African american and she is CR1.  she had many issues with him starting from taking cocaine to stealing money to asking her to pay for his daily needs otherwise he is going to send her home.

she applied for divorce and he kept asking her for money while they are divorcing otherwise he will send her home. SHE decided to leave the house and when she was cleaning the house he stole her passport and green card without her notice.

 

She called the police and he denied on the phone that he has them and she filled a report of him stealing them. 

 

Please give any advice on how to get them back or how to proceed with this because now he is asking her for money to give her the stuff back but not writting that in text messages but only on calls.

 

How she can proceed  please

She can file for new passport and new green card (form I-90). Of course, these will cost her filing fees.

 

Otherwise, she can only hope that police helps her to retrieve them back.

Check with a lawyer in the law in your state pertaining to recording conversations. Many states only require consent of one party, but some require all.

 

If you only need one party, then your friend should record a conversation with him where he asks for the money in lieu of returning the stuff. Then, he can't really say he doesn't have it.

I can have her set up a trap and have them wait until he gives her stuff than arrest him but not sure if that's possible ?

 This would not really be appropriate for 911. But locally you should have a number for police non-emergencies.

 

And even if you go with the police to his house, he can still claim to not have it. They won't have legal reason to force themselves in. If you had proof, you could obtain a search warrant though...

Your friend will need a copy of her green card (front and back) for ROC (I-751) later on.

 

To get a temporary I-551 stamp (served as green card) from local USCIS (infopass appointment), she also needs a unexpired passport.

Since it's a non-emergency, go to your local police station and file a report.

I wouldn't encourage her to try to "set a trap" or anything like that....it could possibly put her in physical danger.

 

Her main concern right now is to get her documents back, and continue on with divorce proceedings.  Later on she can begin to research her options filing for future immigration benefits without him.  

 

In the meantime, she needs to get started on her Plan B (how to get a replacement GC/replacement passport) if she needs to choose that route.  A replacement GC can take around 5-6 months, I've heard.  Right now the fee $455.  Biometrics may be required at an additional $85.00

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

I'm not sure that I understand the relevance of mentioning that your friend is married to an African-American. You then link his race to somebody who uses cocaine and who steals. You are linking somebody's race to criminal activity. That is so not right!

 

As far as I'm concerned, the message that you are trying to convey is lost because you associated the crime with a race.
