Hi, I am currently filling out forms to adjust status through marriage. The new form I-485 asks some questions which I don't understand and I was wondering if anyone could help me.

 

part 2.q3/4. If you are the principal applicant provide the following: receipt number of underlying petition, priority date from underlying petition.

would I leave this blank as I am sending form I-130 along with I-485.

 

q5. If you are a derivative applicant give principal applicants details. 

Am I principal or derivative? My husband will be the one signing form I-130 but I am the one filling out this form so I don't understand.

 

Part 8.Q17. Have you ever violated the terms and conditions of your non immigrant status? Right now I am currently overstaying an ESTA so would the answer to this be yes?

  1. Correct. You don't have a petition number yet since you are concurrently filing.
  2. Principal applicant. Rule of thumb for you: petitioner = your USC spouse, sponsor = your USC spouse (or a joint sponsor), beneficiary = you, applicant = you.
  3. Correct. The overstay will still be ignored for AOS purposes as the spouse of a USC.

do you have any idea how to get transcripts of the tax returns needed for the affidavit of support form?

You can print those or have them mailed. Either is accepted.

i just found this post from a couple months back.. sorry to bother you but as i said above i have overstayed an esta so will click yes for q17.. would i explain the overstay in my additional information pages or leave it as they will already know i have overstayed anyway.
