Hi ,

I wonder if I need to get more evidence , so fat I have our baby birth certificate (yes,we have a baby) , joint bank account , marriage certificate and pictures of us thats all. Is this enough?

I have read that other have like insurance together and etc.

You're  going to need more than that...

 

Any proof of joint tax filing, joint utility bills?  Both names on the lease/mortgage?  Both names on health insurance?

It's not just joint names on documents that you need to think about, it is documentary evidence that you live at the same address, so a drivers license with the address, vehicle registration with your name (or joint names) and that address on it. Insurance documents in your name (or joint names) at that address. Think official, so documents from authoritative sources such as local, state or federal government, financial institutions, phone companies, and the like which show you or both of you at that address are the most helpful. 

 

The more of these kind of documents you have that connect your name to the address, the better. Less authoritative documents such as photos or greetings cards addressed to you both are also useful, but because they don't represent something official, carry rather less weight.

 

However, don't think so much about single things as the overall weight of evidence of your relationship that you can present. Every couple are different, so immigration officers are used to dealing with all kinds of evidence and circumstances. What you do need to understand however is the need to demonstrate that you both live in the same place, so evidence tying you both to the address is important. Ironically, rather more important than the existence of a baby.

Personally I think having a child should carry a lot of weight or importance. I just dont see scammers having a child just to get a greencard

It's certainly happened...even more often than one may assume so. A child is a product of physical contact, not necessarily a relationship between the parents.

I understand what you are saying but at the same time they ( scammers) now have some sort of relationship for the next 18 years as co parents, child support payments, custody fights and the rest of issues that come from unplanned/unwanted children. I think there are much easier ways to a green card than having a child with someone you have no plans of being with long term.

Well, to be fair I never said they don't want kids either or won't take care of them. But the kid itself doesn't mean they have/had an ongoing, active, bona fide relationship. There's plenty of wonderful single parents out there. ;) But yes, I see your point...I disagree on how it is considered here, but I respect the opinion.

I don't have any of that since I'm over staying for almost 2 years so kinda stay with low profile. But have a tons of pics cuz we've been in the relationship for 4years and half now.

It is the totality of the evidence and not one single thing that counts. Just work on getting things together between now and when you file or go to interview.  You can put each other as beneficiaries on life insurance policies / 401K and/or retirement plans, dependents on health insurance,  add each other or get joint car insurance. Get on property deed or mortgage or lease. Do you get mail at same address? it shows you live together. I remember reading on here or another forum when a couple had joint dog(VET) papers. Put each other as emergency contacts at school or work. Get affidavits from friends/relatives/pastor/church members that have knowledge of your marriage. Get joint gym /club memberships. Costco/Sam's club membership, have you gone on vacation together? if you have and have travel itineraries / airline tickets add them. Child's birth certificate with both names counts for something too albeit not a lot.

Basically you have time to get it together - use it wisely.

yes we traveled a lot together and with his family but by car tho. and all my mail sent to the same address that we live. will try to get evidence as much as I can.
